ANNOUNCEMENT AND TERMS OF AUCTION
1. The auction is organised by Antykwariat Numizmatyczny Michał Niemczyk with its registered office in Warsaw, 67, Żelazna Street, Hall 22, 00-871 Warsaw, tax ID 113-271-52-51, company ID 147319064.
2. The Organiser acts as the owner of items listed for auction or as an intermediary for the sale agreement between the owner of the items (the Seller) and the bidders (the Buyer), which does not exclude the possibility that the Organiser can act as the Seller.
3. The Seller concludes an agency contract with the Organiser of the agency, which is separate from the provisions of this announcement and terms of auction.
4. The auction will be held on 03.10.2015 in Warsaw at Jana Pawła II street 21, 00-854 Warsaw (The Westin Hotel).
5. The items listed for the auction are coins, banknotes, decorations, plaquettes, medals, literature and military documents described in the catalogue available on www.aukcjamonet.pl ,which contains the following information: a detailed description, weight, size and starting price. The catalogue does not constitute an offer within the meaning of the Civil Code.
6. The condition for participating in the auction is acceptance of the terms of this auction.
7. The persons that can participate in the auction are the following: a natural person, a legal person or an organisational unit without legal personality, which the law recognises as having legal capacity, hereinafter referred to as a Bidder.
8. All and any persons taking part in the auction agree to submit to the Organiser an identity document in the form of an identity card or passport. The presentation of an identity document shall be provided in order to participate in the auction. All and any persons taking part in the auction agree that the Organiser shall make a photocopy of the presented identity documents, which will be destroyed immediately after the completion of activities related to the auction.
9. When joining the auction, Bidders are required to purchase a bid number. The bid number is a deposit. The Organiser reserves the right to withdraw the request of paying a deposit.
10. The coins, banknotes, decorations, plaquettes, medals, literature and military documents that are the subject of the auction are the property of the Organiser or any third party.
11. If the auctioned items are the property of the Organiser, the auction shall be carried out on behalf and for the account of the owners of the auctioned items.
12. All and any persons taking part in the auction can act on their own behalf or by proxies.
13. Bidders who act on behalf of a third party or an institution can take part in the auction, under the condition of submitting relevant credentials and authorisations.
14. The Organiser guarantees the authenticity of the items described in the catalogue, unless it is expressly stated in the description of the item that this guarantee is not given.
15. The coins, banknotes, decorations, plaquettes, medals, literature and military documents, the authenticity of which is guaranteed by the Organiser shall be issued to the Buyer, together with a Confirmation of Authenticity issued by Antykwariat Numizmatyczny Michał Niemczyk. The Confirmation of Authenticity is a proof of purchase of the item described therein. This document is intended to be marketed only together with the item. The document is invalid if it is not accompanied by the item described therein. It is forbidden to draw up, reproduce by the means of any technical devices and market a Confirmation of Authenticity.
16. The price of coins, banknotes, decorations, plaquettes, medals, literature and military documents described in the catalogue, being an item in the auction is a price estimate. Estimation of the value of the items is made based on the records of previous auction prices and the knowledge of the Organiser.
17. Persons taking part in the auction may view the items before the auction. Any claim concerning the physical characteristics of the auctioned items, their value or condition shall be accepted by the Organiser in writing prior to the auction. From the moment of starting the auction, no claims shall be considered.
18. It is possible to participate in the auction also by submitting a written offer by fax, in electronic form by e-mail as well as „live over the Internet” via our website after registering at the address www.aukcjamonet.pl. An offer to participate in the auction should include all the identity data of the Bidder. Along with the offer, the Bidder shall send to the Organiser a copy of his/her identity card in electronic form by e-mail or by fax. The offer should also indicate the names and numbers of the items to be auctioned, and the limit on the price at which the Bidder is willing to purchase these items. A condition for submitting an bid in an electronic form by e-mail or by fax is payment of a deposit in cash or by bank transfer to the Organiser’s account number indicated below, and sending the confirmation of payment along with the submitted bid. These documents shall be sent to the Organiser’s e-mail: aukcja@niemczyk.pl or by fax number: + 48 22 620 97 61.
19. The auction of the items shall begin at the starting price specified in the catalogue.
20. To the final sale price bid by the Buyer, the Organiser shall add an organisational fee of 15%. The fee includes VAT.
21. The Buyer shall be required to pay to the Organiser the price for auctioned items plus the organisational fee (hereinafter: the Remuneration).
22. The Organiser shall withhold its due organisational fee directly from the amounts paid in accordance with section 26 of this annoucement and terms of auction. 23. The obligation of paying an organisational fee shall constitute a separate item of settlement between the Buyer and the Organiser.
24. The Organiser has the right to increase or decrease the starting price before the end of the auction. ts:

26. A Bidder who bids for items described in the catalogue is required to pay the Remuneration in Polish Zloty within 7 days from the day of the auction. The amount due shall be paid in cash or to the Organiser’s account number indicated below. Should the Bidder fail to pay for the auctioned items, the Organiser shall have the right, on behalf of the Seller, to withdraw from the concluded sale agreement.
27. The items bid at the auction shall be issued to the Bidder after the latter pays the Remuneration.
28. It is possible to postpone the term of payment for auctioned items under a contract between the Organiser and the Bidder, in which the term of payment is expressly defined.
29. The bidding ends when the Auctioneer quotes the price three times and hits the hammer. The auctioneer has the right to requote the price in case of any doubts related to the price amount declared by persons participating in the auction.
30. If the auctioned items are owned by third parties, the Organiser shall not be liable for physical and legal defects of these items. All warranty claims concerning legal and physical defects of the auctioned items shall be addressed to the Seller.
31. This annoucement and terms of auction shall be governed by Polish law and have been drawn up in Polish and English. In case of any discrepancy in the content of the different language versions, the Polish version shall prevail.

33. Also, please remember that, in accordance with art. 51 paragraph 1 section 13 of the Act of 23 July 2003 on the Protection and Conservation of Monuments (Journal of Laws of 2003 No. 162, item 1568) numismatic collections the value of which exceeds 16,000 PLN may be exported abroad on a permanent basis only after obtaining a one-off permit issued by the minister responsible for culture and national heritage.
34. The Organiser reserves the right to change or cancel this announcement and terms of auction until the day of the auction.
