Terms of Sale

1. All bids with respect to the lots mentioned in this catalogue, are subject to the therein mentioned auction conditions. Hence, every seller and buyer accepts, by their sole participation in the auction, these auction conditions. Only the auction conditions formulated in the French language are to be considered the authentic auction conditions. 2. The auction is conducted under the supervision of a bailiff. 3. The lots are offered and auctioned in EURO’s and in the order in which these lots are mentioned in the catalogue. The auction house has taken reasonable care to describe and estimate the lots. The auction house is not responsible for any forged lots (except for the case where it may be expected of a normal, professional auction house that it should have determined the forgery on beforehand). Every bidder is supposed to have previously inspected the lots and to have carried all usual searches and have made all usual enquiries. 4. Except as otherwise stated, the auctioneer only acts as agent for the seller. The contract for the sale of the property is therefore made between the seller and the buyer. Except as otherwise stated, all lots are subject to reserve. No lot will be auctioned if the bid does not equal or exceed that reserve price. The lot in respect of which no bid equal to or exceeding the reserve price is made, will be withdrawn from the auction. 5. The bids take place in the auction room and are made by raising the bid number which will be provided by the auction house to each bidder prior to the auction. The bids can also take place in writing, by letter, fax or e-mail. These written bids should be received by the auction house at least 24 hours before the start of the auction. In case of a dispute, the bidder needs to prove that his bid(s) have reached the auction house in time. 6. Every bidder is supposed to take part in the auction on his own name and on his own behalf. Hence, only he is fully responsible for the payment of the amount bidden in respect of a lot, the surcharge as well as any other related costs and taxes. The bidder can only be exonerated of this responsibility if a written agreement with regard to the person in whose name is bidden, has prior to the auction been accepted by the auction house. 7. The buyer will pay the hammer price + 20% buyer’s fee. (Insurance are paid by the auction house) The auction house reserves the right to demand full payment, i.e. hammer price, buyer’s fee, costs of transportation and taxes, before handing over the auctioned good(s). 8. Bids can only be formulated in amounts which can be divided by 5; eurocentimes will not be taken into account. 9. If during the auction a dispute were to be raised with respect to the amount of the hammer price, the bid will be immediately redone. 10. The lot is granted to the highest bid. In case of equal bids, the lot will be granted to the bid which was formulated first. 11. The price, including buyer’s fee, costs and taxes, is to be paid in cash or by transfer on the account of the auction house with number 732-0325126-33 (IBAN BE79 7320 3251 2633 - BIC CREGBEBB) within 14 days from the auction date. If this term is exceeded by the buyer, the auction house reserves the right to either demand payment of the price or to consider the sale null. In both cases an indemnity equal to 10 % of the hammer price increased with a negligence interest equal to 7 % from the auction date, is due. 12. Once the lot has been handed over to the buyer, the buyer will not be able to raise any disputes regarding the state or condition of the lot. 13. Any dispute must, on penalty of forfeiture, be send by registered letter or fax or e-mail to the auction house within fifteen days from the auction date. In case of a dispute only the tribunals of Mons have jurisdiction.
