Terms of Sale

The auction is held in our own name by order and on account of the seller according to the auction rules and terms in the current version of the
catalogue at any one time and according to the current German legal provisions for commission agents HGB (Commercial Code) and BGB
(German Civil Code).
The purchase price has to be paid in EUR currency. By submitting a written or verbal offer, the auction buyer accepts these auction rules and terms.
The hammer price is the base for the calculation of the buyer’s surcharge fee.
For buyers from EEC countries, the following applies: For customers, a standard surcharge of 23% (relevant VAT already included) applies. For merchants,
according to the Value Added Tax Act, the surcharge is 23 % (relevant VAT already included) for goods delivered with margin scheme. Export
deliveries to EEC countries shall be free of VAT on proof of fulfillment of the relevant legal requirements. For buyers from third party countries (non
EEC country), the following applies: there is a standard surcharge of 20%. If those buyers export the goods themselves or arrange for third parties to
do so, the relevant VAT will be charged, but will be refunded upon presentation of the legal export certificate sealed by customs. In those cases where
WAG online oHG exports these goods, the relevant VAT will not be charged. For books, the following applies: the surcharge is 20% (plus VAT of
7 %). If buyers export the books themselves to non EEC countries or arrange for third parties to do so, the relevant VAT will be charged but refunded
upon presentation of the legal export certificate sealed by customs. In those cases where WAG online oHG exports the books, the relevant VAT will not
be charged. For gold coins, which are not subject to the legal VAT, the surcharge is 15% of the hammer price. Foreign taxes and custom duties will be
imposed on the buyer.
Unless otherwise agreed, payment is due immediately from buyers present at the auction; otherwise, within 20 days after receipt of invoice. Until full
payment is made, the auctioned property and legal title remains with the seller. Payment is normally made by bank transfer. If other methods of payment
are chosen, the buyer must make sure the full invoice amount net of any charges or expenses, is received for the benefit of the seller. Personal cheques
from foreign customers are not accepted. In case of delayed payment, a 1.0 % interest rate is charged monthly. Ownership of the goods shall not pass
until full payment has been made.
Commission bids made by unknown customers will be executed only after verification of sufficient references. Written commissions should be sent at
your earliest convenience. In the event of several identical bids, the first one received will have precedence. Unlimited bids will not be executed. The
client always bids the net price without commission and VAT, which are later added to the final price if the bid is successful.
Phone bids will only be accepted at least two working days prior to the auction and they will be executed at the buyer’s risk. Liability is denied in case
of any technical problems.
Admission to the auction will be granted only to interested parties in possession of the catalogue. The item shall be sold after the highest bid has been
announced three times. The bidder is obliged to take and pay for the bought lots. In case of disagreement about the hammer price, the item in question
will be announced once more. The auctioneer is entitled to combine or to separate any auction lot. The delivery of the goods will be denied if a buyer
present at the auction refuses to pay for the goods no later than the end of the sale or who refuses acceptance of the bought auction goods. In this case,
the buyer shall lose all rights resulting from the award. The item in question can be offered again at his/her expense. In this case, he or she is liable for the
loss of receipts but has no right to claim additional receipts. By refusing awarded lots, the buyer forfeits his right on participating in future auctions.
The rates of increase for bids are normally 5% on top of the last bid. Shipment is effected at the expense and to the risk of the purchaser. Descriptions
of items in the catalogue are made conscientiously. However, they do not create liability for defects of title or for material defects, according to
§ 434, 459-ff. BGB. Details on the condition of the items are given according to the classification of the German coin commerce. Statements are
personal assessments. In principle, auction buyers present at the auction buy items “as inspected”. Complaints lodged by those not present at the
sale have to be filed within 8 days after the end of the auction or after receipt of the goods, respectively.
While objects can be inspected prior to the auction, any claims after the auction can be accepted only in case of erroneous unrecognized mounting
marks, traces of looping, filled holes, etc. The majority of items to be auctioned are illustrated. Complaints about obvious characteristics or general
disapproval are insufficient grounds for any claims. For lots consisting of more than one piece the number of pieces given is only approximate - wrong
descriptions in individual cases can occur. If an erroneous illustration is connected to any item, the only relevance shall be the description.
If goods purchased from us are handed over to a third party Grading Service, we cannot make any guarantee whether the coins would be accepted by
them or graded according to our own grading. Buyers of coins, medals and decorations of the German Reich 1933–1945 assure that they are not using
items with Nazi symbols for any propaganda purposes.
Authenticity of items sold by the auction company is guaranteed unless stated otherwise in the description. Liability for breach of warranty is limited
to the hammer-price plus premium.
The prices given in the catalogue are estimates which can be over-or under-bidden. Commission bids not reaching at least 80 % of the estimated price
will not be executed.
The auctioneer reserves his right to exclude persons from the auction for specific reasons.
Flat rate price for shipping costs including insurance amounts to EUR 7,-, for foreign addresses EUR 10,-. If the total invoice amount is more than EUR
1000, shipping to overseas countries will be done via registered or insured parcel and will be charged with a EUR 30,- flat rate. Excluded are large and/
or heavy lots, where actual postage will be charged for every delivery. For shipping value over 5.000,- EUR the actual postage will be charged as well.
Foreign customers have to buy according to legal provisions on foreign currency exchange, customs and tax regulations of their countries. Dispatching
formalities will be executed by the auctioneer who can choose any qualified forwarding agency. Expenses will be charged to the buyer.
If items need to be shipped, we will charge the hammer price, buyer's premium, shipping expenses plus an additional charge of 0.5 % for shipping
insurance.
All personal data will be used for bookkeeping and invoicing only. They will not be forwarded to third parties.
WAG Online OhG owners and its consignors are liable for damages only in case that a legal obligation applies or that wrongful intent or negligence
could be proven against them.
The liability for the breach of contract is limited to the actual and forseeable damage, not consequential or speculative losses. The auctioneer cannot be
held responsible in any way for consequences arising from technical difficulties, especially for such resulting from connection problems to the internet
and their impact on the auction or possible disadvantages resulting from these. Any translations have been done as precisely as possible, however, only
the German version is legally binding. Please send emails and letters in German or English only.
This agreement shall be governed by and construed in accordance with the laws of Germany. The UN Convention (CISG) on the International Sale of
Goods shall not apply. Against traders and purchasers from abroad, the exclusive jurisdiction shall be the Court of Arnsberg in relation to any dispute
or claim arising out of or in connection with the purchase or the auction process. The invalidity of any provision contained herein shall not affect the
validity of all other provisions. In lieu of any invalid provision, a reasonable provision of the intended effect of such provision shall apply.
After the end of the auction, a result list can be ordered for a nominal fee. It will be published as well online.
Only the German text is legally binding.
