1. Das Auktionshaus H.D.Rauch führt die Versteigerung im Auftrag und für Rechnung der Eigentümer unter Einhaltung der Bestimmungen der österreichischen Gewerbeordnung durch. Mit der Abgabe eines schriftlichen Gebotes erkennt der Kaufinteressent die Auktionsbedingungen im vollen Umfang an.
2. Die Beschreibung im Katalog sowie die Erhaltungseinstufungen wurden mit äußerster Gewissenhaftigkeit vorgenommen. Die Abbildungen der Stücke sind Bestandteil der Beschreibung; im Zweifelsfall hat der Text Priorität. Die im Katalog angegebenen Ausrufpreise sind Mindestpreise in Euro (€), die nicht unterschritten werden können. Der Auktionskatalog kann als PDF-Datei heruntergeladen und ausgedruckt werden. Auf Wunsch kann ein gescannter Katalog zugesandt werden.
3. Auktionsverfahren: Diese Auktion wird nur online durchgeführt und alle Kunden die bereits registriert können online Vorgebote abgeben bzw. direkt während der Auktion mitbieten. Neue Kunden sollten sich rechtzeitig – mindestens 48 Stunden vor dem Auktionsbeginn – auf unserer homepage www.hdrauch.com registrieren damit wir die angegebenen Referenzen überprüfen können. Kunden, die keine stichhaltigen Referenzen abgeben können, werden ersucht, ihre Kreditkartendetails zu senden oder einen Scan ihres Passes. Kunden, die keine Sicherheiten abgeben können bzw. bereits Schulden aufweisen, können nicht mitbieten. Es können uns auch schriftlich Gebote eingeschickt werden, die auch wie die online Vorgebote an der Vorversteigerung teilnehmen. Telefonisches Mitbieten oder Abgabe von Oder-Geboten sind bei den online Auktionen nicht möglich. Da die Vorversteigerung öffentlich gemacht wird, ist es nicht möglich einmal gemachte Gebote zu stornieren. Irrtümer bei der Gebotsabgabe gehen zu Lasten des Kunden. Die Steigerungsstufen betragen in der Regel 5-10%. (siehe Steigerungstufen). Der Zuschlag erfolgt nach dreimaligem Ausruf des höchsten Gebotes und liegt einer Steigerungsstufe über dem letzten Gebot. Der Zuschlag eines Loses verpflichtet den Kunden zur Abnahme und Bezahlung. Bei mehreren gleich hohen schriftlichen Aufträgen erhält das zuerst eingetroffene Gebot den Zuschlag. 4. Preisgestaltung: Der Zuschlagpreis ist ein Nettopreis in Euro im Sinne des Umsatzsteuergesetzes und bildet die Berechnungsgrundlage für das vom Käufer zu zahlende Aufgeld. Der Buchstabe vor der Losnummer kennzeichnet, welcher Steuersatz erhoben wird:
B = Mehrwertsteuerbefreite Münzen: in der Regel Goldmünzen, die als gesetzliches Zahlungsmittel gelten oder ab 1800 galten..
D = Differenzbesteuerte Münzen , Medaillen: Der Käufer zahlt auf den Zuschlagspreis 20%. In dieser Summe ist die gesetzliche Mehrwertsteuer und die Provision enthalten.
E = Lose mit ermäßigten Mehrwertsteuersatz von 10 % . Numismatische Goldmünzen und Silbermünzen.
Ausländischen Münzhändlern aus Ländern der Europäischen Union wird bei Nachweis der Umsatzsteuer-Identifikations-nummer (§27 a UStG) und sonstiger Voraussetzungen gemäß § 4 Nr. 1b UStG in Verbindung mit § 6 a UStG die Lieferung ohne Umsatzsteuer berechnet.
Ausländischen Käufern aus Drittländern wird für alle erworbenen Münzen ein Aufgeld von 15% auf den Zuschlagpreis plus Versandkosten verrechnet, sofern die erworbene Ware von uns exportiert wird. Selbstabholer stellen wir auf Wunsch die Verzollungspapiere bereit wofür die Spedition € 50,-- verrechnet.
5. Der Versand erfolgt auf Kosten und Risiko des Käufers. Für Porto und Versicherung werden folgende Mindestsätze in Rechnung gestellt: Europa € 6,-- und außereuropäische Länder € 15,--. Ausländische Kunden kaufen nach den Devisen-, Zoll- und Steuerbestimmungen ihres Landes. Versandformalitäten werden vom Versteigerer erledigt. Alle Bieter erhalten mit dem Versand der Ware bzw. mit der Verständigung, dass sie bei der Auktion nicht erfolgreich waren, die Ergebnisliste.
6. Zahlungsmodalitäten und -frist: Sofern nichts anderes vereinbart wird, ist die Zahlung der Auktionsrechnung bei anwesenden Käufern sofort, bei schriftlichen Bietern spätestens 10 Tage nach Erhalt der Ware fällig. Bei Zahlungsverzug werden Zinsen von 1% pro angefangenen Monat verrechnet. Das Eigentumsrecht geht erst nach voller Bezahlung der Ware an den Käufer über . Wir behalten uns das Recht vor, Lose zurückzubehalten und erst nach voller Bezahlung auszuliefern. Anwaltskosten, Gerichtskosten und andere im Zusammenhang mit dem Inkasso entstehende Kosten gehen zu Lasten des Käufers. Bei Bezahlung mit Kreditkarte und Pay Pal werden 3 % zur Rechnungssumme hinzugerechnet; Schecks werden wegen der hohen Bankkosten nicht angenommen bzw. sind € 30,-- zur Gesamtsumme hinzuzurechnen; ausgenommen sind US Dollar Schecks bezogen auf eine Bank in den Staaten.
7. Reklamationen: Alle Münzen werden vorbehaltlos als echt und gemäß der Beschreibung garantiert.
Die Ware kann eine Woche vor dem Auktionstermin bei uns im Büro besichtigt werden. Erhaltungsangaben Dritter wie von NGC oder PCGS können nicht beim Auktionshaus Rauch reklamiert werden. Berechtigte Reklamationen werden selbstverständlich anerkannt, nur müssen die reklamierten Stücke in dem von uns gelieferten Zustand sein. Münzen und Medaillen in Erhaltung "schön" oder minderer Qualität sind von der Qualitätsgewährleistung ausgeschlossen, ebenso Lots, die generell nicht reklamiert werden können (die angegebene Stückzahl - wenn nicht grob abweichend - ist nur als Zirka-Angabe zu verstehen). Ausgenommen von der Reklamationsfrist ist die Echtheit der Stücke für die wir bis zur Höhe des Kaufpreises immer garantieren. Bei Meinungsverschiedenheiten kann der Versteigerer Sachverständige seiner Wahl beiziehen; die Kosten trägt die unterlegene Partei.
Die Reklamationsfrist von 8 Tagen nach Erhalt der Ware ist strikt einzuhalten. Bei Kunden, die auf Vorauskasse kaufen, können Reklamationen nur bis 20 Tage nach der Auktion entgegengenommen werden. Reklamationen werden von uns grundsätzlich für Rechnung der Einlieferer erledigt. Es bleibt uns vorbehalten, die Bieter, soweit Ansprüche gegeben sind, darauf zu verweisen, diese direkt gegen den Einlieferer geltend zu machen. Davon wird immer dann Gebrauch gemacht, wenn mit dem Einlieferer bereits abgerechnet ist.
8. Gerichtsstand für alle Verfahren ist Wien. Wir behalten uns jedoch auch das Recht vor, den Schuldner an seinem Wohnsitz zu klagen. Nur der deutsche Text der Auktionsbedingungen ist rechtsgültig

AUCTION TERMS AND CONDITIONS of an e-Live AUCTION
The auction is conducted by H.D. Rauch on behalf and for the account of the owner of the goods according to Austrian Trade Regulation Acts. The submission of a bid – written or oral – implies the express acknowledgement of these Terms and conditions of auction.
1. Description: The descriptions and the grading of the material represented in the catalogue have been executed with great care. The illustrations are part of the description and in case of doubt the text is authoritative. The auction catalogue can be loaded as Pdf file also split up in chapters. We will gladly sent out a scanned copy of the catalogue if wanted.
2. Auction procedures: The auction sale is conducted in Euros. The most successful bidder has committed himself personally to the purchases made; he cannot claim to have acted on behalf of a third party. The prices in the catalogue are minimum prices and bids below these prices cannot be accepted.
This auction is live online auction and all clients who are registered for bidding live make pre bids online and / or bid directly during the auction. New customers have to register on our homepage www.hdrauch.com at least 48 hours before the auction starts in order to be able to verify the references given for guarantee. The new clients could also send us the details of his credit card or a scan of this passport. Clients who do not have established credit with the Auction House H.D. Rauch ories or have debts cannot take part in our auctions.
Prebids can be sent in by letter, fax, e-mail or with the online facilities. All these pre bids will take part in the public online pre bidding. Bidders are responsible for errors in bidding, therefore please control that your bids are entered in the bid sheet.
The bidding increments as a general rule are 5 to 10 %. In case of identical bids, the earliest bid wins..
3. Hammer price: An item will be knocked down after the highest bid has been called out three times. The hammer price will be executed at one bidding increment over the next highest bid. All auction sales are final.
4. Invoice: The hammer price represents the basis for the buyer’s premium of 20 % in which VAT (Value Added Tax) is included due to the § 24. Buyers resident outside the EEC pay a buyer’s premium of 15 % and are not charged VAT if the goods are delivered by us or if the buyer can confirm the export of the goods by himself. The letter in front of the lot number indicates the percentage of the VAT.
B = zero rated coins. Gold coins issued after 1800 and which were or still are legal tender and investment gold.
D = Auctioneer’s Margin Scheme. 20 % are added to the hammer price. VAT and the buyer’s premium are included.
E = reduced VAT rate of 10 % for medals and coins in gold of numismatic value and silver coins.
Dealers in the EEC countries (other than Austria) will receive goods tax free upon presentation of their valid VAT ID number.
Buyers resident outside the EEC pay a buyer’s premium of 15 % and are not charged VAT if the goods are exported by us.
Purchasers from abroad will have to observe all applicable laws and regulations in respect of custom duties and taxation in their country. If the goods are exported by the buyer himself we will provide the export papers from a freighter (the costs are € 50,--).
5. Payment period: Unless mutually agreed otherwise, payment of the auction bill is due immediately if the buyer is present on the floor; this is also valid for bidders who have acted on behalf of another client From new bidders we will ask payment in advance. Rauch GmbH reserves the right to deem the sale incomplete and to resell the material and the bidder agrees to pay for the reasonable costs of such a sale and also pay any difference between the resale price and the previously successful bid. The payment can also be done by credit card (VISA and MASTER) or paypal if the client adds a surcharge of 3 % to the total sum of the invoice for the handling. US Dollar checks drawn to an US bank are accepted, not checks in Euro unless the clients adds to the sum of the invoice the high bank costs. Ownership of the lots will not pass until payment of the purchased price is made in full. After the period of 30 days has expired 1 % interests are charged per month.
6. Shipment: All shipping charges will be borne by the buyer of the auction goods. Instructions for shipping must be given right after the auction. We ship the goods according e postal regulations or by special service if wanted by the client or necessary for the insurance. The minimum costs are: Domestic: € 6,--; Europe: € 10,--; overseas: € 15,--. Any shipment is insured. Insurance regulations require that losses or damage in shipment be reported immediately and that some evidence (photo, damaged envelops) are sent. If the client does not receive the shipment in time or it is damaged the buyer has to inform us upon receipt because investigations are only accepted by the post for shipments three months old. The buyer or recipient is liable for the costs of shipment which are returned by post because of the carelessness of the buyer or recipient. Clients who ask for shipment to another person have to provide a written agreement of the person who should receive the shipment.
7. Complaints and authenticity. First of all please be aware that an auction sale is not an approval sale. The auction material can be viewed a week prior to the auction sale. Coins and medals in this sale are guaranteed genuine and as described if not some additional information are provided in the description. For claiming the authenticity of coins and medals there is no time limit and is warranted up to the total purchase price. The costs shall be borne by the party loosing the dispute according to the expert’s decision. All other claims which are due to an error in description (like plugging of a hole, traces of mounting etc.) must be made within 8 days after receiving the auction material: Coins that have been encapsulated (“slabbed”) by a grading company such as NGC or PCGS may not be returned for any reason, including authenticity, if they have been removed from the slab; also the grading from a third party cannot be claimed by the auction house H.D. Rauch GmbH. If bidders who have to pay in advance fail to settle the sum due within 20 days the time for claims because of errors in description has run out. Lots graded as fine or lesser as well as multiple lots are excluded from any claim. Claims are handled on behalf of the owner or seller i.e. the person or company who instructed the auctioneer to offer the material for sale. We reserve for us the right to ask the buyer to turn directly to the owner with his claim. This will always be the case when the account with the seller has been settled. Payments for shipment which got lost will be returned as soon as the postal investigation has confirmed the loss of the shipment. Claims for authenticity if proofed have no time limit.
8. Any and all disputes should be subjected to the exclusive jurisdiction of Vienna courts, except for those to recover payment for lots sold here under which may be pursued wherever the buyers may be found.

УСЛОВИЯ ТОРГОВ НА АУКЦИОНЕ
1. Аукционный дом H.D.Rauch GmbH проводит аукцион от имени и за счет владельцев при соблюдении условий австрийского торгового права. Сделав ставки письменно или устно (по телефону), клиент выражает свое согласие с условиями аукциона.
2. Описание лотов в аукционном каталоге, а также данные о состоянии товара очень подробные. Изображения экземпляров являются составной частью описания. В спорном случае текст имеет преимущество.
3. Ставки. Электронный аукцион ориентирован на тех коллекционеров, которые предпочитают самостоятельно делать ставки во время аукциона. Преимуществом электронного аукциона является то, что покупатель сам следит за ходом аукциона и имеет предварительную информацию о размере уже сделанной ставки. Условием принятия участия в электронном аукционе является правильная регистрация на нашем сайте (www.hdrauch.com). Успешно зарегистрировавшись один раз в интернете, вы делаете ставки на всех аукционах в прямом эфире, согласно условиям оплаты и участия на аукционе. Новые участники должны зарегистрироваться за два рабочих дня до начала аукциона, для того, чтобы мы успели проверить присланные сведения о клиенте, до аукциона прислать нам копию паспорта или номер кредитной карточки и срок ее действия, если до аукциона мы не получаем рекомендации о клиенте, ставки не будут приняты.
Каждый участник может сделать предварительную ставку в интернете и в любое время проконтролировать размер предложенной ставки. Предложения цены могут присылаться в письменной форме (по почте, факсу, электронным письмом или через интернет-каталог) или по телефону по желанию клиента.
Так как электронный аукцион проводится без аукциониста, (в данном случае аукционистом является компьютер), все участники должны строго придерживаться шкалы увеличения ставок. Если ставка не соответствует шкале, то она будет автоматически приравнена к следующей более высокой ставке. За неправильно услышанные и присланные ставки отвечает клиент.
Примите во внимание, что участие по телефону в электронном аукционе не допустимо, а ставки присланные в письменном виде нельзя анулировать.
4. Указанные в каталоге ставки являются минимальными, они не занижаются. Лот получает тот участник, который предложил наибольшую ставку. Конечная ставка выше предыдущей на одну ступень. При наличии нескольких одинаковых ставок, лот получает тот покупатель, чья ставка пришла раньше всех участников. Все продажи во время аукциона являются окончательными.
5. Формирование цены: Конечная цена на аукционе - это цена без учета налогов и сборов, она составляет основу для счёта клиента. Буква перед номером лота обозначает взимаемый налог:
D = монеты и медали обложенные дифференцированным налогом. Это значит, что к конечной цене лота прибавляются 20% (это налог и комиссионные расходы аукциона вместе взятые) плюс почтовые расходы и страховка.
Иностранным дилерам из стран Европейского Союза при предъявлении идентификационного номера плательщика НДС (§ 27a «закона о налоге с оборота») и с учетом § 4 № 1б и § 6а. НДС не начисляется.
Иностранным покупателям из всех остальных стран за все приобретенные монеты начисляются только 15% комиссионных плюс почтовые расходы и страховка, если приобретенный товар отправляется нами.
6. Рассылка товара производится за счет и риск покупателя. Иностранные клиенты покупают товар учитывая нормы налогового управления и таможенной службы их страны. Формальности по рассылке выполняет аукционист. Минимальные расходы за пересылку и страховку: Австрия - € 6,00, Европа - € 10,00, все остальные страны € 15,--. Все клиенты получают список с результатами аукциона либо вместе с товаром, либо с информационным письмом.
7. Срок оплаты: покупатели, приславшие ставки письменно, оплачивают счет не позднее 15 дней после получения товара. За несвоевременную оплату начисляется 1 % за каждый начатый месяц. Мы сохраняем право за собой удерживать лоты и отправлять их лишь после полного погашения счета. Право собственности переходит покупателю только после полной оплаты счета. Расходы на адвоката, суд и другие, связанные с взысканием долга берет на себя покупатель. При оплате кредитной картой или через систему pay pal кредитным институтом взимаются расходы в размере 3 % от общей суммы оплаты. По новым правилам банка переводы внутри Европейского Союза намного экономичнее, чем оплата чеком.
8. Рекламация: Всем монетам без исключения согласно описанию гарантируется подлинность. Так как клиент имеет возможность предварительно посмотреть состояние товара, выставляемого на нашем аукционе, то жалобы относительно его качества или описания после аукциона не принимаются. Если товар забирается лично, то любые претензии по качеству или неверному описанию принимаются в день получения товара. Обоснованные рекламации естественно принимаются, рекламируемый товар должен быть в том же состоянии, в котором он был в момент его получения. Монеты, состояние которых оценено как «отличное» или низкого качества, исключены из гарантии качества, так же как и лоты состоящие из нескольких единиц нельзя рекламировать, т.к. это данные приблизительного качества.
9. Срок подачи рекламации составляет 8 дней после получения товара. Клиенты покупающие товар по предоплате могут подать жалобу в течение 20 дней со дня проведения аукциона. Рекламации проводятся в основном только за счет поставщика. Мы оставляем право за собой, направлять покупателей прямо к поставщику, если с ним уже произведен расчёт.
10. Юрисдикция и место исполнения суда- город Вена. Мы имеем право подать в суд на должника по месту его жительства.
Юридическую силу имеет только немецкий текст условий торгов на аукционе.
