Terms of Sale

1. The auction is organised by Antykwariat Numizmatyczny Michał Niemczyk with its registered office in Warsaw, 67, Żelazna Street, Hall 22, 00-871 Warsaw, tax ID 113-271-52-51, company ID 147319064.
2. The Organiser acts as the owner of items listed for auction or as an intermediary for the sale agreement between the owner of the items (the Seller) and the bidders (the Buyer), which does not exclude the possibility that the Organiser can act as the Seller.
3. The auction take place in the Internet: www.aukcjamonet.pl (eLive auction).
4. The condition for participating in the auction is registration which means acceptance of the terms of this auction.
5. The client (bidder) is granted individual credit (limit of expenses); the offers higher than this limit/credit will not be accepted.
6. The persons that can participate in the auction are the following: a natural person, a legal person or an organisational unit without legal personality, which the law recognises as having legal capacity, hereinafter referred to as a Bidder.
7. All and any persons taking part in the auction agree to submit to the Organiser an identity document in the form of an identity card or passport. The presentation of an identity document shall be provided in order to participate in the auction.
8. Customers without references or know by Company, made a written offer or wishing to bid live (on-line), they are obliged to pay to the Company’s bank account deposit in the amount of 20% of the start price. Antykwariat Numizmatyczny Michał Niemczyk may refrain from demanding deposit payment if the customer is known.
9. Auction objects which are the subject of the auction are the property of the Organiser or any third party. If the auctioned items are not the property of the Organiser, the auction shall be carried out on behalf and for the account of the owners of the auctioned items.
10. All and any persons taking part in the auction can act on their own behalf or by proxies. Bidders who act on behalf of a third party or an institution can take part in the auction, under the condition of submitting relevant credentials and authorisations.
11. The Organiser guarantees the authenticity of the items described in the catalogue, unless it is expressly stated in the description of the item that this guarantee is not given.
12. Auction prices described in the catalog are starting prices. Each item auction is accurately described in the directory accessible to www.aukcjamonet.pl. The directory does not constitute an offer within the meaning of the Civil Code.
13. Auction items of which authenticity is guaranteed by the Organiser shall be issued to the Buyer, together with a Confirmation of Authenticity issued by Antykwariat Numizmatyczny Michał Niemczyk. This document is intended to be marketed only together with the item. The document is invalid if it is not accompanied by the item described therein. It is forbidden to draw up, reproduce by the means of any technical devices and market a Confirmation of Authenticity. the auction, and therefore will be treated as if they had seen and studied the status of objects. Any dispute concerning the physical characteristics of the auctioned items, their value or condition will be accepted by the Organizer in writing before the auction. With begining of the auction any objections will not be considered.
15. Participation in the auction can be taken also by submitting a written bid via fax, in electronic form by e-mail as well as "live via the Internet" after the registration on the website www.aukcjamonet.pl. Offer for the auction should contain all the identification of the bidder and the numbers and names of items to be auctioned, along with pricing limits, for which the bidder is willing to purchase items. Sent information with the offer is the submission of an offer to buy.
16. Information about the highest grading notes are checked up to three months before the auction. The organizer is not responsible for the appearance of new objects with higher notes.
17. The customer has the right to cancel the purchase only in case of significant non-compliance of auctioned item described in the directory www.aukcjamonet.pl
18.To the final sale price, the Organiser will add an organisational fee of 15% of the hammer price. The fee includes VAT.
19. The buyer is obliged to pay the Organiser price for the auctioned items plus organizational fee (later: the Remuneration) and pay all costs associated with shipping auctioned items and the cost of payments (bank fees and online payment systems).
20. The Organiser has the right to increase or decrease the starting price before the end of the auction.

22. A Bidder who bids for items described in the catalogue is required to pay the Remuneration in Polish Zloty within 7 days from the day of the auction. The amount due shall be paid in cash or to the Organiser’s account number indicated below. Should the Bidder fail to pay for the auctioned items, the Organiser shall have the right, on behalf of the Seller, to withdraw from the concluded sale agreement or will be charged interest for each day of delay.
23. It is possible to postpone the term of payment for auctioned items under a contract between the Organiser and the Bidder, in which the term of payment is expressly defined.
24. The items bid at the auction shall be issued to the Bidder after the latter pays the Remuneration.
25. The bidding ends when the Auctioneer quotes the price three times and hits the hammer. The auctioneer has the right to requote the price in case of any doubts related to the price amount declared by persons participating in the auction.
26. If the auctioned items are owned by third parties, the Organiser shall not be liable for physical and legal defects of these items. All warranty claims concerning legal and physical defects of the auctioned items shall be addressed to the Seller.
27. This announcement and terms of auction shall be governed by Polish law and have been drawn up in Polish and English. In case of any discrepancy in the content of the different language versions, the Polish version shall prevail.

Also, please remember that, in accordance with art. 51 paragraph 1 section 13 of the Act of 23 July 2003 on the Protection and Conservation of Monuments (Journal of Laws of 2003 No. 162, item 1568) numismatic collections the value of which exceeds 16,000 PLN may be exported abroad on a permanent basis only after obtaining a one-off permit issued by the minister responsible for culture and national heritage.
30. The Organiser reserves the right to change or cancel this announcement and terms of auction until the day of the auction.
