Terms of Sale

This is an internet auction organized by Warin Global Investments S.A. (hereinafter referred to as WGI) and its partner Redpoint Consulting Limited (hereinafter referred to as Redpoint or wwww.live-bidder.com).
The present general conditions of sale apply to all persons participating in the auctions of currencies concluded on the website www.live-bidder.com. Making an offer to buy or an auction implies full acceptance of the following terms of sale, and in particular acceptance of items 5, 7 and 8:

Anyone wishing to participate in the Live Sales or place purchase orders prior to sale via Redpoint must be registered on www.live-bidder.com in the WGI section. It is advisable to register at least 12 hours before the sale so that the references can be verified.

Bids are made in Euro. The sale follows the order of the catalog numbers. The prices indicated in the catalog are the "starting prices". During the sale, the starting prices may be higher than the starting price mentioned in the catalog according to the purchase orders received before the sale. Purchase orders below the starting price will not be considered. WGI reserves the right, at any time and at its sole discretion, to refuse an auction, withdraw a lot or reopen it.
The lot will be awarded at the highest bid and will require the buyer to accept the prizes at the auction price plus applicable taxes and fees. During the sale, the 'Fair Warning' message is clearly displayed on the bidder's screen for a few seconds. Upon extinction of this message, the lot is awarded. The bidder is thus encouraged to place his last bid as soon as the 'Fair Warning' message appears. The placement of a bid during the appearance of this message cancels the latter which will reappear a few seconds later. The invitation to tender will be awarded by preference in order of receipt and acceptance of the tenders.

Purchase orders can be placed before the sale either by email, by fax or via the Redpoint website (the complete and perfect operation of this website can not be guaranteed by WGI). Purchase orders are accepted up to 12 hours before the start of the sale. In the event of orders placed by a person unknown to WGI or its partners, WGI reserves the right to refuse a purchase order or to request a deposit from the bidder.
The purchase order implies the unconditional acceptance of the purchase of the lot concerned at least at the value of the starting price mentioned in the catalog, incremented by the different fees and taxes. If we have your email address, you will receive a confirmation of receipt of your offer to purchase by email.

Commissions and taxes:
A buying commission of 10% of the bid price is added to the invoiced amount of the lot (s) acquired and forms an integral part of the amount due.
Payment is due in euros immediately after the auction. The prizes will not be sent or delivered until the invoice has been paid in full. The maximum period of payment is 30 days from the issue of the invoice.
A late payment interest of 1% per month will be charged for any late payment.
Any duly justified claim must be sent within 14 days of receipt of the prizes

The buyer is personally responsible for his / her purchase (s) and therefore acts on his / her own behalf and can not claim to have acted on behalf of a third party. He is personally responsible for the payment of the lot (s) awarded, fees, taxes, commissions and delivery charges or bank charges.

The dispatch of the lots awarded will be made, after payment, at the expense, risk and peril of the purchaser. The transfer of ownership of the lot (s) awarded shall be effective only after full payment of the tender price and the additional costs referred to in point 5. However, at the time of award, all risks relating to the lot (s) (S) will be transferred to the successful tenderer in their entirety and without the slightest reservation. All taxes payable abroad (customs duties and taxes) are entirely borne by the buyer.

The description and the state of conservation of the coins have been rigorously studied and given in full conscience and good faith. WGI guarantees the authenticity of the currencies. Claims for multiple lots can not be accepted. Justified claims can only be taken into consideration within 14 calendar days of the physical delivery to the buyer or to a third party designated by him of a lot - within which the buyer has a right of withdrawal .
All lots may be examined personally, or through a representative, on our premises on the days and times specified in the catalog.

Any dispute arising out of these general conditions is the exclusive competence of the district courts of Luxembourg. However, WGI reserves the right to seize the courts of the buyer's domicile.
In case of dispute, only the French version of the general conditions is authentic.
