1. The auction is organised by Antykwariat Numizmatyczny Michał Niemczyk with its registered office in Warsaw, 67, Żelazna Street, Hall 22, 00-871 Warsaw, tax ID 113-271-52-51, company ID 147319064.
2. The Organiser acts as the owner of items listed for auction or as an intermediary for the sale agreement between the owner of the items (the Seller) and the bidders (the Buyer), which does not exclude the possibility that the Organiser can act as the Seller.
3. The auction will be held on 21.10.2017 in Warsaw at Jana Pawła II street 21, 00-854 Warsaw (The Westin Hotel).
4. The condition for participating in the auction is registration which means acceptance of the terms of this auction.
5. The client (bidder) is granted individual credit (limit of expenses) for the online auction only; the offers higher than this limit/credit will not be accepted.
6. The persons that can participate in the auction are the following: a natural person, a legal person or an organisational unit without legal personality, which the law recognizes as having legal capacity, hereinafter referred to as a Bidder.
7. All and any persons taking part in the auction agree to submit to the Organiser an identity document in the form of an identity card or passport. The presentation of an identity document shall be provided in order to participate in the auction.
8. Customers without references or know by Company, made a written offer or wishing to bid live (also on-line), they are obliged to pay to the Company’s bank account deposit in the amount of 20% of the start price (twenty percent). Antykwariat Numizmatyczny Michał Niemczyk may refrain from demanding deposit payment if the customer is known.
9. Auction objects which are the subject of the auction are the property of the Organiser or any third party. If the auctioned items are not the property of the Organiser, the auction shall be carried out on behalf and for the account of the owners of the auctioned items.
10. All and any persons taking part in the auction can act on their own behalf or by proxies. Bidders who act on behalf of a third party or an institution can take part in the auction, under the condition of submitting relevant credentials and authorizations.
11. The Organiser guarantees the authenticity of the items described in the catalogue, unless it is expressly stated in the description of the item that this guarantee is not given.
12. Auction prices described in the catalog are starting prices. Each item auction is accurately described in the directory accessible to www.aukcjamonet.pl. The directory does not constitute an offer within the meaning of the Civil Code.
13. Auction items of which authenticity is guaranteed by the Organiser shall be issued to the Buyer, together with a Confirmation of Authenticity issued by Antykwariat Numizmatyczny Michał Niemczyk. This document is intended to be marketed only together with the item. The document is invalid if it is not accompanied by the item described therein. It is forbidden to draw up, reproduce by the means of any technical devices and market a Confirmation of Authenticity.
14. Customers participating in the auction may view the items before the auction, and therefore will be treated as if they had seen and studied the status of objects. Any dispute concerning the physical characteristics of the auctioned items, their value or condition will be accepted by the Organizer in writing before the auction. With beginning of the auction any objections will not be considered.
15. Participation in the auction can be taken also by submitting a bid in electronic form by e-mail as well as „live via the Internet” after the registration on the website www.aukcjamonet.pl. Offer for the auction should contain all the identification of the bidder and the numbers and names of items to be auctioned, along with pricing limits, for which the bidder is willing to purchase items. Sent information with the offer is the submission of an offer to buy.16. Information about the highest grading notes are checked up to three months before the auction. The organizer is not responsible for the appearance of new objects with higher notes.
17. The customer has the right to cancel the purchase only in case of significant non-compliance of auctioned item described in the directory www.aukcjamonet.pl
18.To the final sale price, the Organiser will add an organisational fee of 15% of the hammer price. The fee includes VAT.
19. The buyer is obliged to pay the Organiser price for the auctioned items plus auctions fee (later: the Remuneration) and pay all costs associated with shipping auctioned items and the cost of payments (bank fees and online payment systems).
20. The Organiser has the right to increase or decrease the starting price before the end of the auction.
21. The Organiser shall carry out the bidding according to the bid increments.
22. A Bidder who bids for items described in the catalogue is required to pay the Remuneration in Polish Zloty within 7 days from the day of the auction. The amount due shall be paid in cash or to the Organiser’s account number indicated below. Should the Bidder fail to pay for the auctioned items, the Organiser shall have the right, on behalf of the Seller, to withdraw from the concluded sale agreement or will be charged interest for each day of delay.
23. It is possible to postpone the term of payment for auctioned items under a contract between the Organiser and the Bidder, in which the term of payment is expressly defined.
24. The items bid at the auction shall be issued to the Bidder after the latter pays the Remuneration.
25. The bidding ends when the Auctioneer quotes the price three times and hits the hammer. The auctioneer has the right to requote the price in case of any doubts related to the price amount declared by persons participating in the auction.
26. If the auctioned items are owned by third parties, the Organiser shall not be liable for physical and legal defects of these items. All warranty claims concerning legal and physical defects of the auctioned items shall be addressed to the Seller.
27. This announcement and terms of auction shall be governed by Polish law and have been drawn up in Polish and English. In case of any discrepancy in the content of the different language versions, the Polish version shall prevail.

29. Also, please remember that, in accordance with art. 51 paragraph 1 section 13 of the Act of 23 July 2003 on the Protection and Conservation of Monuments (Journal of Laws of 2003 No. 162, item 1568) numismatic collections the value of which exceeds 16,000 PLN may be exported abroad on a permanent basis only after obtaining a one-off permit issued by the minister responsible for culture and national heritage.
30. The Organiser reserves the right to change or cancel this announcement and terms of auction until the day of the auction.
31. This document is a work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2006 No. 90, item. 631). It is forbidden to copy, reproduce and distribute its content for commercial use.

OGŁOSZENIE I WARUNKI AUKCJI

1. Organizatorem aukcji jest Antykwariat Numizmatyczny Michał Niemczyk z siedzibą w Warszawie, ul. Żelazna 67 pawilon 22, 00-871 Warszawa, NIP 113-271-52-51 REGON 147319064
2. Organizator występuje jako właściciel przedmiotów wystawianych na aukcji lub jako pośrednik przy zawarciu umowy sprzedaży pomiędzy właścicielem tych przedmiotów (Sprzedającym) a licytującym (Kupującym), co nie wyklucza sytuacji, że Organizator będzie Sprzedającym.
3. Aukcja odbędzie się w dniu 21.10.2017 r. w Warszawie, przy ul. Jana Pawła II 21, 00-132 Warszawa (hotel Westin).
4. Warunkiem uczestnictwa w aukcji jest wcześniejsza rejestracja jednoznaczna z zaakceptowaniem warunków niniejszej aukcji.
5. Klientowi, zwanemu dalej Licytującym, który będzie brał udział w aukcji online, przyznawany jest kredyt wydatków, czyli maksymalna kwota, jaką klient jest skłonny wydać podczas całej aukcji. Oferty po przekroczeniu limitu nie będą akceptowane
6. Udział w aukcji może wziąć osoba fizyczna, osoba prawna albo jednostka organizacyjna nie będąca osobą prawną, której ustawa przyznaje zdolność prawną, zwane dalej Licytującym.
7. Klienci biorący udział w aukcji zgadzają się na przedstawienie Organizatorowi dokumentu tożsamości w postaci dowodu osobistego lub dokumentu paszportowego. Okazanie dokumentu tożsamości będzie warunkiem wzięcia udziału w licytacji.
8. Klienci nie znani wcześniej firmie, składający pisemną ofertę lub chcący licytować na żywo (również on-line), zobowiązani są do wpłaty na firmowe konto bankowe wadium w wysokości 20% (słownie: dwadzieścia procent) ceny startowej. Antykwariat Numizmatyczny Michał Niemczyk może odstąpić od żądania wpłacenia wadium jeżeli klient jest znany.
9. Przedmioty aukcyjne są własnością Organizatora albo osób trzecich. W przypadku, gdy licytowane przedmioty nie są własnością Organizatora aukcja przeprowadzana jest na zlecenie i na rachunek właścicieli licytowanych przedmiotów.
10. Klienci biorący udział w aukcji mogą działać w imieniu własnym lub przez pełnomocników. Licytujący, którzy działają w imieniu osób trzecich lub instytucji mogą wziąć udział w aukcji pod warunkiem przedłożenia stosownych pełnomocnictw i upoważnień.
11. Organizator gwarantuje autentyczność przedmiotów znajdujących się w katalogu, chyba że w opisie danego przedmiotu znajduje się wyraźne zastrzeżenie, iż gwarancja taka nie została udzielona.
12. Ceny przedmiotów aukcyjnych opisane w katalogu, są cenami startowymi. Każdy przedmiot aukcyjny jest dokładnie opisany w katalogu dostępnym na www.aukcjamonet.pl. Katalog nie stanowi oferty w rozumieniu przepisów Kodeksu cywilnego.
13. Przedmioty aukcyjne, których autentyczność jest gwarantowana przez Organizatora wydawane są nabywcy wraz z Gwarancją Autentyczności wystawianym przez Antykwariat Numizmatyczny Michał Niemczyk. Gwarancja Autentyczności przeznaczona jest do obrotu tylko łącznie z przedmiotem. Dokument jest nieważny w przypadku, gdy nie występuje wraz z opisanym w nim przedmiotem. Zabrania się sporządzania, powielania za pomocą jakichkolwiek urządzeń technicznych oraz wprowadzania do obrotu Gwarancji Autentyczności.
14. Klienci biorący udział w licytacji mogą obejrzeć przedmioty przed rozpoczęciem aukcji, dlatego będą traktowani tak jakby widzieli i studiowali stan przedmiotów. Wszelkie zastrzeżenia dotyczące cech fizycznych licytowanych przedmiotów, ich wartości lub stanu przyjmowane będą przez Organizatora w formie pisemnej przed rozpoczęciem aukcji. Z chwilą rozpoczęcia aukcji jakiekolwiek zastrzeżenia nie będą uwzględniane.
15. Udział w aukcji można brać również w formie elektronicznej przez e–mail jak również „na żywo przez Internet” po dokonaniu rejestracji na stronie internetowej www.aukcjamonet.pl. Oferta udziału w aukcji powinna zawierać wszystkie dane identyfikacyjne Licytującego oraz numery i nazwy przedmiotów, które mają być licytowane wraz z limitami cenowymi, za które Licytujący wyraża chęć zakupu tych przedmiotów. Przesłanie oferty jest równoznaczne ze złożeniem oferty na zakup.
16. Informacje o najwyższych notach gradingowych są sporządzane do trzech miesięcy przed aukcją. Organizator nie ponosi odpowiedzialności za pojawienie się nowych przedmiotów z wyższymi notami.
17. Klient ma prawo do odstąpienia od zakupu wyłącznie w przypadku znaczącej niezgodności wylicytowanego przedmiotu z opisem zamieszczonym w katalogu na www.aukcjamonet.pl
18. Do wylicytowanej ceny Organizator dolicza Kupującemu opłatę aukcyjną w wysokości 15% wylicytowanej ceny. Opłata zawiera podatek VAT.
19. Kupujący zobowiązany jest do zapłaty Organizatorowi ceny za wylicytowane przedmioty powiększonej o opłatę aukcyjną (dalej: Wynagrodzenie) oraz opłacenia wszelkich kosztów związanych z wysyłką wylicytowanych przedmiotów i kosztów płatności (prowizje bankowe oraz prowizje systemów płatności internetowych).
20. Organizator aukcji ma prawo do podwyższenia lub obniżenia ceny startowej przed zakończeniem aukcji.
21. Organizator aukcji przeprowadza licytację według stopni przebicia.
22. Uczestnik aukcji, który wylicytował przedmioty umieszczone w katalogu jest zobowiązany do uiszczenia Wynagrodzenia w walucie Złoty Polski w terminie 7 dni od dnia licytacji. Należność powinna zostać uiszczona w formie gotówkowej lub na wskazany poniżej numer konta Organizatora. W przypadku braku uiszczenia zapłaty za wylicytowane przedmioty Organizator ma prawo odstąpić w imieniu Sprzedającego od zawartej umowy sprzedaży lub spowoduje naliczanie odsetek za każdy dzień zwłoki.
23. Istnieje możliwość odroczenia terminu zapłaty należności za wylicytowane przedmioty na mocy umowy pomiędzy Organizatorem, a Licytującym, w której termin ten zostanie wyraźnie określony.
24. Przedmioty wylicytowane na aukcji zostaną wydane Licytującemu po dokonaniu całkowitej zapłaty Wynagrodzenia.
25. Zakończenie licytacji następuje po trzykrotnym wywołaniu ceny i jej przybiciu. Licytator ma prawo ponownie wywołać cenę w przypadku zaistnienia jakichkolwiek wątpliwości osób biorących udział w licytacji dotyczących wysokości ceny.
26. W przypadku gdy licytowane przedmioty są własnością osób trzecich Organizator nie odpowiada za wady fizyczne i prawne tych przedmiotów. Wszelkie roszczenia z tytułu wad prawnych i fizycznych wylicytowanych przedmiotów kierowane są do Sprzedającego.
27. Niniejsze ogłoszenie i warunki aukcji podlegają prawu polskiemu i zostały sporządzone w języku polskim i angielskim. W przypadku zaistnienia jakichkolwiek rozbieżności w treści warunków sporządzonych w poszczególnych wersjach językowych moc wiążącą ma wersja polska.
28. Wszelkie należności i opłaty należy wpłacać na konto firmy:

29. Zgodnie z art. 51 ust. 1 pkt 13 ustawy z dnia 23 lipca 2003 r. o ochronie zabytków i opiece nad zabytkami ( Dz. U. z 2003 r. Nr 162, poz. 1568 ) kolekcje o znaczeniu numizmatycznym, których wartość jest wyższa niż 16 000 zł mogą być wywiezione za granicę na stałe po uzyskaniu jednorazowego zezwolenia wydanego przez ministra właściwego do spraw kultury i ochrony dziedzictwa narodowego.
30. Organizator zastrzega sobie możliwość zmiany oraz odwołania niniejszego ogłoszenia i warunków aukcji do dnia aukcji.
31. Niniejszy dokument stanowi utwór w rozumieniu ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych ( Dz. U. z 2006 r. Nr 90 poz. 631). Zabrania się kopiowania, powielania oraz rozpowszechniania jego treści na użytek komercyjny.
