Terms of Sale

GENERAL

1st. The catalogue prices are the lowest price in which a lot can be sold and they are in €UROS.

2nd. The lots will be awarded to the highest bidder. If there are two or more identical bids, the one received first is given priority.

The lowest bid accepted for those lots with a starting price LIBRE is 5 €UROS. Some lots can have a reserve price impose by the vendor.

3rd. The total invoice will include 18% on the hammer price plus shipping and/or insurance cost. The delivery of the sold lots will be invoiced generically, whatsoever the circumstances or place of residence of the purchaser, including VAT in compliance with the Specific Regime for used goods, works of art, antiquities and collector’s items.

4th. Bids and payments must be made in Euros (€). If payment has not been received within 30 days after the auction date, SOLER Y LLACH S.L.U. reserves the right to cancel the sale and to dispose of the lots elsewhere and/or take legal proceedings in order to collect the amount due and damages and losses incurred.

From 1 to 100 EUROS - 5 EUROS
From 100 to 200 EUROS - 10 EUROS
From 200 to 500 EUROS - 20 EUROS
From 500 to 1,000 EUROS - 50 EUROS
From 1,000 to 3,000 EUROS - 100 EUROS
From 3,000 to 5,000 EUROS - 200 EUROS
From 5,000 EUROS at the Auctioneer’s discretion

5th. NO REFUNDS OR CLAIMS ARE ACCEPTABLE for the lots with several items.


6th. The Auctioneer reserves the right to refuse any bidding order, to withdrawn one or more lots from the Sale and to group together two or more lots from the Sale at his discretion.

Property. Lots remain the property of the seller until full payment has been received, including clearance of checks and bills of exchange.

7th. The mere participation in this Sale implies that the buyer accepts the above mentioned conditions.

8th. All the buyers ought to obey Spanish Fiscal and Customs Laws.


9th. Any legal proceedings concerning this Sale will be submitted to the exclusive jurisdiction of the Courts of Barcelona.


10th. According to the “Right of Pre-emptive” (law 16/1985 art. 38) the Spanish Government has the right to purchase any lot at the hammer price.


11th. The authenticity of the coins is warranted (up to the total purchase price) unless anything to the contrary is noted in the catalogue or the auction. In other respects, any and all warranty claims based on material defects of quality and defects of title are excluded.

12th. The Organization will not be responsible for the interrumption under the mode on-line for reasons beyond our control.


13th. The text that compels the parties concerned in the auction, is the one published in Spanish, remaining the other versions to theoriginals in Spanish.



BIDDING ORDERS:



14th. Any prospective buyer who is not a regular customer of SOLER Y LLACH S.L.U. must provide trade references and sufficient financial guarantees for their bids to be accepted.



15th. The lots sold to you can be sent by CASH ON DELIVERY or by mail AFTER THE RECEPTION OF YOUR PAYMENT. Payments can also be made BY POSTAL ORDER, BY CHECK or through a BANK TRANSFER with your name and invoice number,

16th. Payments in any other currency will be exchanged to €UROS at the rate of the day of the reception of the payment.

17th. Mail and insurance expenses will be paid by the buyer.

18th. Coins with faults not described in the catalogue can be returned within 10 days after the reception of the lots. Any claim afterthis period of time will be rejected.

19th. After 45 days of the date of the Sale, no devolution will be accepted. You should send a signed letter of authorisation indicating the number of your card and its expiry date. The charge will figure in your bank account in the currency of your country.

ROOM SALE:

20th. Bidders in the Room Sale will pay and take their purchases away after the Sale or in the following 5 days, from the next day of the Auction.



21st. No refunds or claims will be accepted of lots once they have been sold by the Auctioneer.



22nd. The Organization reserves the right of admission to the Room Sale.



23rd. Telephone bids during the Sale can be arranged for those lots with a starting price over 300 Euros. The bidder is obliged to bid for the starting price or for one more bid in case the starting price has already been covered. The Room Sale is not responsible for the lack of telephone connection or any kind of telephone failure. In this case, the Auctioneer will cover the

starting price on behalf of the telephone bidder.
