Terms of Sale

1. The auction is organized by Antykwariat Dawid Janas (hereinafter: Organizer), Nowy Świat street 5/5, 00-496 Warszawa, Polska (hereinafter: Organizer’s headquarters), REGON number: 147466836, NIP number: 5291569189; e-mail address: antykwariatdj@gmail.com
2. The auction is held on the order and the account of the owners of the items sold (hereinafter: the Seller), which does not exclude the possibility that the Organizer is simultaneously the Seller. The transfer of items for auction sale and settlement with third party Sellers is the subject of separate agreements.
3. Pre-registration is the prerequisite for participation in the auction, which means acceptance of these terms of the auction.
4. 4. Within the framework of registration, the bidder (hereafter: the Auction Participant) obtains a basic spending limit of 50000 PLN above which he can not bid. The Organizer may grant the auction participant a higher spending limit on his request made in writing or sent by email within 3 days prior to the start of the auction. Increasing the limit may be conditional upon the payment of a bid security amounting up to 20% of the spending limit.
5. In the case of registration of persons unknown to the Organizer or in case of the Organizer having doubts about the identifying information of the Auction Participant, it is possible to make the participation in the auction conditional by presenting an identity document (ID card or passport document) to the Organizer or a security deposit of 20% of the spending limit.
6. The subject of the auction are coins, medals, antiques and other collectibles, whose indefinite originality is guaranteed by the Organizer unless otherwise stated in their description. For any other physical defects as well as for legal defects, the Seller is liable.

8. Description of auction items is given in good faith. Any comments and objections regarding their characteristics should be reported to the Organizer in writing or by email prior to the start of the auction. If comments or objections are taken into account, they will be made public to the auction participants immediately before the auction of the item to which they relate.
9. Participants of the auction have the opportunity to see the objects in the Organizer's office on working days, 10.00-18.00, to the day preceding the day of auction start.
10. Participants in the auction will be treated as if they were directly (live) watching and analyzing the physical characteristics of the auction items.
11. Bidding starts with the starting price set by the Organizer in the catalog. The Organizer has the right to raise or lower the starting price in the situation referred to in point 9, II.
12. The auction organizer shall bid according to the following increments:

13. The auction ends after the price has been raised three times, the highest bid and acknowledging the highest bid. In case of doubts about the course of auction of a given item, the Organizer has the right to repeat the auction.
14. For special purposes in the catalog of objects, the Organizer adds a fee resulting from the so-called Droit de suite- the rights of the creator and his heirs to receive remuneration for professional resale of original copies of works. The above fee is calculated according to the following rates:
1) 5% of the quoted amount if this part is in the range up to the equivalent of EUR 50,000, and
2) 3% of the quoted amount, if this part is in the range from the equivalent of EUR 50,000.01 to the equivalent of EUR 200,000, and
3) 1% of the quoted amount, if this part is in the range from the equivalent of EUR 200,000.01 to the equivalent of EUR 350,000, and
4) 0.5% of the quoted amount, if this part is in the range from the equivalent of EUR 350,000.01 to the equivalent of EUR 500,000, and
5) 0.25% of the quoted amount, if this part is in the range exceeding the equivalent of 500,000 euro - but not higher than the equivalent of 12,500 euros.
In Poland droit de suite is governed by art. 19-195 of the Copyright and Related Rights Act of 4 February 1994, as amended, in line with the European Union Directive 2001/84 / EC of the European Parliament and of the Council of 27 September 2001 on author's right to remuneration Resale of the original copy of the work of art.
15. The auction participant is obliged to pay the Organizer the price of the auctioned items, plus an auction fee of 12% of the price (hereinafter referred to as settlement). The charge includes VAT. The Organizer may extend the deadline for settlement as a result of an agreement with the Auction Participant, in writing or by email. The Organizer reserves the right to reduce the auction fee to some Auction Participants. Reducing the fee for a particular Participant is subject to individual decision.
16. The settlement is made in the following currency: Polish zloty (PLN), in cash, at the Organizer's premises or by transfer to the Organizer's bank account: 86 1140 2004 0000 3602 7537 7447
17. Upon agreement with the Organizer of the exchange rate, it is possible to settle in foreign currency in cash or by making a transfer to the Organizer's bank account:

18. In the event of failure to settle within time, the Organizer has the right to withdraw from the contract of sale of items auctioned by the Participant or to charge statutory interest for late payment.
19. Issue of the auctioned items takes place after receipt of the receipt at the Organizer's office, starting from the first working day after the auction ends. 10.00-18.00. In the case of selecting the delivery of items by post, the Auction Participant shall, at settlement, also pay the cost of the selected form of shipment, as set out in the Annex to these Terms and Conditions.
20. The place to settle any disputes is civil court, which is appropriate for the headquarters of the Auction Organizer.
21. Changes or cancellations of the terms and conditions of the auction may be made by the Organizer in exceptional cases until the day of the auction.
22. These terms and conditions of the auction constitute a work within the meaning of the Act of 4 February 1994 (Journal of Laws of 2017, item 83).
