Terms of Sale

1. The auction of coins, medals, plaques, banknotes and other numismatic material listed in the catalogue is organized by the Auction House MACHO & CHLAPOVIČ a.s. in the interest of its clients. The Auction House acts with the approval and for the account of the owners of the goods. By submitting a bid in writing, on-line or on the floo, the bidder unconditionally agrees with the contents of these Conditions. The auction is conducted in accordance with the Slovak law and the rights and duties of the participants which are not explicitly dealt with herein shall be governed by the respective provisions of the Slovak Commercial Code. Auction sale under these Conditions shall not be considered as auction sale pursuant to Act No. 527/2002 Coll.

2. Participation: The auction is open to domestic as well as to foreign natural persons or legal entities who enjoy their full legal capacity and meet all the conditions for participation in the auction. Participants in the auction are allowed to act and buy goods only in their own name and for their account. Representation is excluded. Remote participation in the auction is possible by submitting limit bids in writing, limit bids by fillin the form at auction’s house webpage (www.numizmatikamch.sk) or by submitting limit bids at Sixbid (www.sixbid.com). Real-time remote participation in the auction is also possible via Core Tech on-line system (www.coretech.ss). Participation is conditional upon submitting a valid identificatio document of the participant (as for the legal persons, the statutory body is obliged to submit the identifiction document together with an excerpt from the commercial or other public register not older than 3 months) and upon submitting completed registration form, including solemn declaration and consent to the processing of personal data. Participants who submit limit bids are obliged to send the stipulated documents together with their limit bids, otherwise the limit bid is invalid. Bidders unknown to us are also required to provide references and must deposit 20% of their bids in advance. The deposit shall be applied against payment of the purchase price by the successful bidder, with any overpayment refunded. The registration form as well as bid sheet form the annex of this catalogue and are available also on the webpage of the Auction House. The Auction House reserves the right to exclude from the auction proceedings persons who behave inappropriately.

3. Description and inspection of the material: The description of the material and the grading in the catalogue have been executed with great care. The photo-graphs are part of the description and in case of doubt the text is authoritative. All materials listed in the catalogue can be personally inspected before the auction during the time set in catalogue.

4. Auction procedure: Before the start of the auction, each participant receives a bidder number that will be used during the auction for bidding. During the auction proceedings, each participant is responsible that its bidder number is not used by any other person. We diligently carry out limit bids, free of charge, but we don't take responsibility for any errors in the bid sheets.
The prices printed in the catalogue are minimum prices in Euro (€) and bids below cannot be accepted. The auction will proceed as directed by the auctioneer. The Auction House reserves the right to split, merge or skip particular items differently than presented in catalogue, as well as to change their sequence or to include unsold item in auction again. The auction of particular item begins by calling its sequence number and its starting price in Euro. The minimum bid steps are set depending on the last bid as follows:

up to 20 €: 1 € 200 € - 500 €: 20 € 5.000 € - 10.000 €: 500 €
20 € - 50 €: 2 € 500 € - 1.000 €: 50 € 10.000 € - 50.000 €: 1.000 €
50 € - 100 €: 5 € 1.000 € - 2.000 €: 100 € 50.000 € - 100.000 €: 2.000 €
100 € - 200 €: 10 € 2.000 € - 5.000 €: 200 € from 100.000 €: 5.000 €
Limit bids, if they are not a multiple of the above bid steps, shall be rounded to the nearest possible lower bid step. If identical bids are submitted, limited bid shall prevail over the bid on the floor and the bid on the floor shall prevail over the on-line bid. In case of identical bids of the same type, the earliest will take precedence.

The hammering occurs when the highest bid has been called out three times and no higher bid arrives. The hammering obliges the successful bidder to take over the goods and to pay the purchase price. Bidders on the floor must object to the hammering immediately, later submitted objections shall be disregarded. In case of any dispute concerning the auction procedure, the Auction House shall finally decide.

5. Prices: The hammered-price is the basis for adding the buyer's premium of 15% to each lot. The hammered-price and the buyer's premium together are the purchase price. The purchase price includes applicable Slovak VAT, which will be paid by the Auction House and cannot be refunded. All fees and taxes due abroad are the buyer's responsibility.

6. Payment conditions: We accept payment only in Euro or Czech Crowns (calculated at the exchange rate of NBS valid on the previous day). Unless individually agreed otherwise, bidders on the floor have to pay immediately and all other bidders have to pay within 7 days from the last day of auction. After this period expires, 0.05% default interest is charged per day. Ownership title of the lots shall not pass until the full payment of the purchase price is received. The buyer is responsible for judicial fees, attorney fees and other expenses involved in collection of any overdue debt.

7. Shipment: Shipping is at the expense and risk of the buyer, handling and insurance charges will be added to invoices (minimum charges: Europe: € 7, rest of the world: € 15). Foreign buyers when exporting objects of cultural value are obliged to obtain respective permit in accordance with Act No. 207/2009 Coll. Each bidder, whether successful or not, will receive within three weeks after the auction a list with the prices realized.

8. Claims: All coins in this sale are guaranteed genuine and as described. Due to the opportunity to inspect the merchandise in advance, floor buyers purchase merchandise "as is" and may not return it for reasons other than authenticity. Claims by the participants who did not attend the auction in person will be considered only if obvious defects have been overlooked and not described in the catalogue, or otherwise visible. Participants who collect the goods personally must claim such obvious defect upon receipt, absentee bidders within 7 days upon receiving the goods. No claims will be accepted after this date. The claimed lot must be in the same condition as delivered. Items graded as "fine" or lesser quality as well as multiple lots are excluded from warranty. Claims are handled on behalf of the client i.e. the person or company who instructed the Auction House to offer the goods for sale. We reserve the right to refer the buyer with its claim directly to the original owner of the goods.

9. Final provisions: Any and all disputes arising from the auction sale under these Conditions shall be subject to jurisdiction of Slovak courts of law, the Auction House however reserves the right to proceed with the recovery of debts for goods sold hereunder wherever the buyers may be found. In case of any discrepancies, the Slovak version of these Conditions shall prevail.
