Terms of Sale

The auction is held by order and on account of the seller according to the auction rules in the current version at any one time and to the current German legal provisions for commission agents HGB (Commercial Code) and BGB (German Civil Code). The purchase price has to be paid cash down in EUR currency.
By making a written or verbal offer, the auction buyer accepts these terms of auction.
The hammer-price is the net price. It is the basis for a premium of 15% to be paid by the auction buyer. The hammer-price and the premium add up to the total price, which is subject to the German VAT. Application of the full or reduced VAT rate is subject to the current legal provisions.
Unless agreed otherwise, buyers present at the auction have to pay auction bills immediately. In case of written offers, auction bills become due for payment 14 days after receipt of the bill. In case of default of payment, interest rates to the amount of one percent interest will be charged per month.
Commissions of undisclosed principals will be carried out only after deposit of money or indication of references. Written commissions should be sent at the earliest possible time. In the event of several identical bids, the first received will have precedence. There is no obligation to carry out unlimited commissions unconditionally. Phone bids will only be accepted in exceptional cases and have to be filed at least one work day prior to auction.
Admission to the auction will be granted only to interested parties having possession of the catalogue. The highest bid is knocked down after the third exclamation of the bid. The auction buyer is obliged to purchase and make payment. In the event of the hammer-price being the point of dispute, the item concerned will be offered again. The auctioneer is entitled to combine or to separate numbers of items.
The auction buyer who does not pay the auctioneer immediately or who refuses to purchase the bought item(s) will not be delivered the bought item(s).
The item concerned then can be offered again on his account. In this case he is liable for the loss of receipts but has no right to claim additional receipts.
The minimun rates of increase for bids are as follows:

Shipment is effected on account and at risk of the auction buyer. Until payment is made in full, the seller retains title to the items.
Descriptions of items in the catalogue are made conscientiously. However they do not create liability for defects of title or for material defects, according to §434, 459‑ff. BGB. Details on the state of items are given according to the classification of the German coin commerce. Statements are personal assessments.
On principal, auction buyers present at the auction buy items “as seen”. Complaints have to be filed within 8 days after auction or after receipt of the goods, respectively.
The objects can be viewed before the auction in order to convince oneself of their proper state. Therefore, after knocking down, only complaints about wrongly missed mount marks, filled holes etc. will be considered. The majority of items that will be auctioned off are pictured. Complaints about obvious characteristics or general disapproval are thus in no case a reason for reclamation. For lots consisting of more than one piece the number of pieces given is only approximate, wrong descriptions in individual cases can occur. If by any chance a wrong illustration has been picked, the major relevance lies with the text associated with it.
If goods purchased from us are handed over to a third party Grading Service, we can't take any responsibilities that the items will be accepted or graded according to our grading standards.
Buyers of coins, medals and decorations of the German Reich 1933–1945 assure that they are not using items wearing symbols of the Nazi rule for propaganda purposes.
Authenticity of items sold by the auction is guaranteed unless stated otherwise in the description. Liability for breach of warranty is limited to the hammerprice plus premium.
The prices given in the catalogue are estimations which can be over- or underbid. Commissions not reaching at least 80% of the estimated price will not be carried out.
The auctioneer reserves his right to exclude persons from the auction for specific reasons.
Flat rate price for shipping costs including insurance amounts to EUR 7,-, foreign customers EUR 10,- except in the case of large and/or heavy lots, where actual mailing expenses will be charged for each delivery. If total invoice amount is higher than EUR 1000,- shipping to overseas countries will be done via registered or insured package and will be charged with a EUR 30,- flat rate. Foreign customers have to buy according to legal provisions on foreign currency exchange, customs and taxes of their countries. Dispatching formalities will be executed by the auctioneer who can choose any qualified forwarding agency.
Costs will be imposed upon the auction buyer.
If items need to be shipped, we will charge the hammer price, buyer's premium, shipping costs and an additional 0,5% for shipping insurance.
Payment has to be executed via bank transfer. If other methods of payment are chosen, the customer has to take care that the total invoice amount is paid out.
Non-negotiable cheques are not accepted.
In the event of the auction buyer being a merchant according to the “Commercial Code”, venue shall be Arnsberg as the place of auction.
Unless stated otherwise, general auction conditions and German law apply in relation to domestic and foreign customers alike.
After completion of the auction, a list of results can be obtained on payment of a EUR 3,00 charge.
Only the German text has the force of law.
