1) The auction in conducted on behalf and for the account of the owners of the goods and is subject to Austrian Trade regulations. Bids at the sale, by writing or telephon are taken to imply full acceptance of the condition of sale. Purchase orders in writing will be executed by the auctioneer in the buyers interest at no additional fee.

2) The description of the material and the grading in the catalogue are executed with great care. The photographes are part of the description and in case of doubt the text is authoriative.

3) The prices printed in the catalogue are minimum prices in EURO and bids below cannot be accepted. In the event of identical bids, the earliest will take precedence. The auctioneer will increase according to the following jumps.

From 1 - 30 by 1 EURO
From 30 - 50 by 2 EURO
From 50 - 150 by 5 EURO
From 150 - 300 by 10 EURO
From 300 - 600 by 20 EURO
From 600 - 1500 by 50 EURO
From 1500 - 3000 by 100 EURO
From 3000 - 7000 by 200 EURO

In the event of any dispute during floor bidding, the auctioneer has the right to re-open the bidding or recall the lot and put it up for sale again.

4) Items subject to margin tax (Differenzbesteuerung) are not seperatly marked in the catalogue will be subject to 20% premium in which the VAT of 20% is included. Items subject to full taxation (they are marked with V in the catalogue) will be subject to a 15% buyers premium on the hammer price plus the VAT of 10%. Gold coins that are free of VAT are subjected with a buyers premium of 18%. Delivery to companies which are subject to VAT and have registered seat in a member state of the European Union is subject to the acquisition tax applicable in the respective country of destination. In such case the delivery is exempt from VAT, provided our company is informed of the buyer?s applicable VAT registration number prior to the acceptance of the bid.

5) Shipping is at the expense and risk of the buyer. Handling and insurance charges will be added to invoices. Any loss in the mail is covered by the auctioneers own insurrance. Not included are reclamations. They must be sent back in an insurrenced letter. Minimum charges are in Austria Euro 4,00; in Europe 7,00 and Non-European countries Euro 15,00.

6) If nothing else is arranged in advance, bidders on the floor have to pay immediately. All other customers have to pay within 10 days upon receipt of goods or in case of advance payment, after an invoice is sent. After the period of 10 days has expired 1% interest is charged per month. Ownership of the lots shall pass until payment in full of the purchased price is made. The buyer is responsible for attorney and other judical fees and expenses involved in collection of any overdue debt.

7) All objects in this sale are guaranteed genuine and as described. No lots may be returned by floor buyers except for reasons of authenticity. Complaints by mail bidders will only be considered if obvious defects, have been overlooked and not described in the catalogue. Customers who collect the goods personally must take the claims upon receipt, absentee bidders within 8 days upon receiving the goods. No claims will be accepted after this date. The claimed lot must be in the same condition as delivered. Objects graded fine or lesser qualitiy as well as multiple lots are excluded from warranty. Claims are handled on behalf of the owner or seller in evidence the person or company who instructed the auctioneer to offer the material for sale. We reserve for us the right to ask the buyer to turn directly to the owner with this claim. This will always be the case when the accounts with the seller have been settled.

8) Any and all disputes shall be subject to the exclusive jurisdiction of the Salzburg courts, except for those to recover payment for lots sold herunder which may be pursued whereever the buyer may be found. The German version of the conditions of sale is definitiv in the event of any disputes.



1) Die Versteigerung wird im Auftrag und für Rechnung der Eigentümer unter Einhaltung der Bestimmungen der österreichischen Gewerbeordnung durchgeführt. Mit der Abgabe eines schriftlichen oder mündlichen Gebotes erkennt der Kaufinteressent die Auktionsbedingungen in vollem Umfang an. Schriftliche Aufträge werden von den Veranstaltern der Auktion ohne Berechnung zusätzlicher Kommission interessenwahrend ausgeführt.

2) Die Beschreibung im Katalog sowie die Bestimmung der Qualität erfolgt mit äußerster Gewissenhaftigkeit. Die Abbildungen der Stücke sind Bestandteil der Beschreibung. Im Zweifelsfall hat der Text Priorität.

3) Die im Katalog angegebenen Ausrufpreise sind Mindestpreise in EURO, die nicht unterschritten werden können.
Diese Steigerungsstufen sind bindend eine Abweichung ist nicht möglich.

Die Lose werden dem Höchstbieter verkauft, wie er vom Auktionator ermittelt wird. Bei mehreren gleich hohen schriftlichen Aufträgen erhält das zuerst eingetroffene Gebot den Zuschlag. Wenn der Auktionator nichts anderes bestimmt, werden die Lose in der Nummernfolge des Kataloges verkauft. Bei Missverständnissen während der Auktion ist der Auktionator berechtigt, die Steigerung neu zu eröffnen oder das Los zurückzurufen und nochmals auszurufen.

4) Bei differenzbesteuerten Objekten, welche im Katalog nicht gesondert bezeichnet sind, wird ein einheitliches Aufgeld von 20% einschließlich gesetzlicher Umsatzsteuer aufgeschlagen. Bei Objekten, die der Vollbesteuerung unterliegen (Katalogkennzeichnung V), wird zum Meistbot eine Käufergebühr von 15% hinzugerechnet. Auf den so ermittelten Betrag (Nettopreis) wird dann die gesetzliche Umsatzsteuer hinzugerechnet. Auf Goldmünzen, die den Kriterien der Steuerbefreiung gem. ? 6 Abs. 1 Z 8 lit. j Umsatzsteuergesetz 1994 entsprechen, wird ein Zuschlag von 18% hinzugerechnet. Lieferungen an umsatzsteuerpflichtige Unternehmen mit Sitz in einem Mitgliedsland der Europäischen Union unterliegen der Erwerbssteuer im jeweiligen Bestimmungsland. In diesem Fall ist die Lieferung der Objekte in Österreich umsatzsteuerfrei, wenn uns vor dem Zuschlag die gültige Umsatzsteueridentifikationsnummer (UID) des Käufers bekanntgegeben wird. Das Aufgeld beträgt in diesem Fall 13%, der zum Meistbot hinzugerechnet wird.

5) Der Versand erfolgt auf Kosten und auf Risiko des Käufers. Verluste beim Versand auf dem Postweg sind durch eine Versicherung gedeckt. Rücksendungen sind davon nicht erfasst. Diese müssen nach den Bestimmungen der Postverwaltung des Aufgabelandes erfolgen. Für Porto und Versicherung werden mindestens in Rechnung gestellt: Inland Euro 4,00; Europa Euro 7,00 und außereuropäische Länder Euro 15,00.

6) Sofern nichts anderes vereinbart wird, ist die Zahlung der Auktionsrechnung bei anwesenden Käufern sofort, bei schriftlichen Bietern 10 Tage nach Erhalt fällig. Bei Zahlungsverzug werden Zinsen von 1% pro angefangenen Monat verrechnet. Das Eigentumsrecht geht erst nach voller Bezahlung der Ware auf den Käufer über. Wir behalten und das Recht vor, Lots zurückzubehalten und erst nach voller Bezahlung auszuliefern. Sämtliche mit dem Inkasso entstehenden Kosten gehen zu Lasten des Käufers.

7) ) Alle Objekte werden vorbehaltslos als echt und gemäß der Beschreibung garantiert. Alle anwesenden Bieter kaufen grundsätzlich wie besehen. Sie können keine Beanstandungen betreffend Qualität und Beschreibung nach erfolgtem Zuschlag geltend machen. Berechtigte Reklamationen werden selbstverständlich anerkannt, nur müssen die reklamierten Stücke in dem von uns gelieferten Zustand sein. Objekte in Erhaltung schön oder minderer Qualität sind von der Reklamation ausgeschlossen; ebenso Lots und Sammlungen. Prüfungsgebühren gehen zu Lasten des Käufers. Die Reklamationsfrist von 8 Tagen ist strikt einzuhalten. Es bleibt vorbehalten, die Bieter, soweit Ansprüche gegeben sind, darauf zu verweisen, diese direkt gegen den Einlieferer geltend zu machen. Davon wird dann Gebrauch gemacht, wenn mit dem Einlieferer bereits abgerechnet ist.

8) Gerichtsstand ist Salzburg. Wir behalten uns aber auch das Recht vor, den Schuldner an seinem Wohnsitz zu klagen. Nur der deutsche Text der Auktionsbedingungen ist rechtsgültig.
