Terms of Sale

Note: Customers must agree to abide by the following terms and conditions when participating in Ginza Coin Auctions. By participating in an auction, customers shall be considered to have agreed to these terms and conditions.
1. GINZA COINS COMPANY (hereafter referred to as “the Company”) certifies that all auction items listed in the catalogs of auctions, which it operates, are genuine articles at the time of the auction.
2. Participants in this auction must register in advance of the commencement of the auction. Where a participant has not had past dealings with the Company, or a participant is not known to the Company, the Company may require said participant to provide proof of identity, verification of assets, or to pay a temporary deposit, as part of registration.
3. The Company may refuse registration or entrance the auction site upon receiving a postal bidding application, without giving reason, entirely at its own discretion.
4. The prices attached to all auction items are reference prices based on professional appraisals. Where no advance bids been received for an item, bidding will commence from a starting price of 80% or 90% of the reference price (however, for items for which there is a reserve price, bidding will commence from the reference price). Where advance bids have already been received, the starting price shall be the next bidding increment up from the second highest bid.
5. The participant who submits the highest bid for a given item shall be the winner of the auction for that item. Furthermore, in the event of a dispute among participants during an auction, all parties agree to resolve matters according to the judgement of the Company’s auctioneer. All parties to auctions must abide by the decisions of the auctioneer.
6. In the event of problems with online bidding (such as system failure) on the day of an auction, the organizer shall bear no responsibility whatsoever to the bidder or the seller. If said problems are not resolved within a set period of time, the auction shall continue on the auction floor only. (For further details, see the Live Bidding Guide).
On Payment for Auction Goods
7. The successful bidder shall pay the Company the amount of the successful bid price, plus a 10% commission fee, plus 10% consumption tax on the amount of the commission fee. The successful bidder shall make payment for the auctioned goods in the currency of Japan within 14 days of the day of the auction. The Company shall not allow the successful bidder to remove any item until the full amount has been paid, without exception for any lot.
E.g.) A successful bid price of 100,000 yen.

8. If the successful bidder fails to pay the full amount by the payment deadline, the Company shall send a new invoice adjusted for greater than the prevailing interest rate. If payment is still not made, the purchase contract shall be voided, and the Company shall have no future dealings whatsoever with the successful bidder. Furthermore, if the Company incurs any damages as a result of the voiding of said contract, it shall claim damages from the successful bidder.
9. The Company shall send the customer who was the successful bidder a sealed letter containing an invoice, and a “Table of Successful Bids,” covering all auctioned items. Customers who wish to have their auctioned goods sent to them by post must send the amount of the invoice plus 500 yen to cover the costs of shipping and insurance to the financial institution specified by the Company (this is limited to customers within Japan). The goods will then be sent by registered mail upon confirmation of payment.
10. For overseas deliveries, these will be handled based on discussions between the Company and the successful bidder about the shipping method and insurance costs. Additionally, any customs or import duties arising in overseas countries shall be entirely the responsibility of the successful bidder, and in the event of an accident, the Company accepts no liabilities whatsoever.
On Returns by the Successful Bidder
11. The Company shall accept appeals regarding auctioned goods only from successful bidders themselves, who have paid the full amount of all invoices, within 30 days of the auction. (For example, a valid appeal would be in the case of an extremely rare auctioned item that was proven to be a forgery, despite nothing to this effect being cited in the special report on said item. Alternatively, this would also apply to the case of an item being found to be something completely different to what it was listed as in the catalog).
12. Even in the event that the successful bidder applies for a return within the allotted period, the Company shall be unable to accept returns particularly in cases which are covered by the following items. The Company appreciates the understanding of its customers in this regard.
〇 Items that the customer has previously inspected.
〇 Items that are specifically listed as “no returns” or “subject to dispute among experts.”
〇 Items which are not in the same state and condition as on the day of the auction.
〇 Cases in which payment was made after the payment deadline.
〇 Cases where payment has already been settled with the seller.
〇 Slabbed coins, which have been graded by companies such as PGCS or NGC.
〇 Cases where the condition of the auctioned item indicated by the Company differs to that indicated by an external appraiser (excepting forgeries).
〇 Successful bids that are the result of errors in filling out the bidding application form, or mistakes in the operation of the online bidding system.
〇 Cases where the Company is unable to agree to a return, due to the patent unfairness of the reason for requesting a return.
13. Approximately one month from the day on which the successful bidder makes their payment, the Company shall begin making full payment to the seller. As a result, the company is unable to consider any appeals for return of auctioned items after thirty days from the day of the auction have elapsed, no matter the reason for said appeal.
Note: The Company’s Auction Operations Department makes all possible efforts to photograph items subject to auction in a manner that faithfully reproduces the color tone of the original. As it is, however, impossible to capture this fully in auction catalog photos, or in online images, we strongly urge customers to inspect goods personally if they are at all able to do so. Additionally, the Company will make every effort to respond to inquiries from customers regarding the tone of the items, and the state of any minor blemishes.
