Terms of Sale

§ 1. DEFINITIONS

„Organizer” - NUMIS.POLAND Spółka z ograniczoną odpowiedzialnością Spółka Komandytowa with registered office at ul. Leopolda Okulickiego 35, 61-413 Poznań, Tax ID: 7811904992, REGON: 360559027, disclosed in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number: 0000535935, which issues items for auctions via the Onebid.pl portal.
“Auction” – the auction is conducted via the Onebid.pl portal with an Internet address https://onebid.pl/.
“Participant” – an entity participating in the Organizer's Auction on the Onebid.pl portal.
“Auction winner” – The participant whose offer was the highest, which was confirmed and who won the auction.
„Agreement” – a sales agreement concluded with the Auction Winner in the cases described in detail below.
„Auction fee” – this is an additional fee not included in the currently presented offer. It is additionally added to the amount that the winner of the auction has to pay. Its height has been determined below.


§ 2. PARTICIPANT’S CONSENTS

The Participant, by taking part in the Auction, accepts and agrees to the content of these regulations.
The Participant expresses voluntary consent for the Organizer to process his personal data for purposes related to the Auction and the conclusion and finalization of the Agreement.
The participant also declares that he has read the Regulations of the Onebid.pl portal and fully accepts it.


§ 3. AUCTION

The auction takes place only on the Onebid.pl portal. The time of the auction, its detailed terms and its subject are each time specified on the website of the item on the Onebid.pl portal. In the absence of any other objections, the following auction rules apply.
The Auction Participant may only be an adult and having full legal capacity under Civil Law, legal persons and organizational units that are not legal entities to which the law gives legal capacity.
The Auction starts only with the moment specified on the website of the given item from the starting price.
The object may have a specific minimum offer below which the conclusion of the Agreement requires the consent of the owner.
All offers submitted before the start of the auction in any form are invalid.
Binding and valid are only offers submitted during the Auction via the Onebid.pl portal.
An offer submitted in the course of the Auction ceases to be binding when another Participant of the Auction has submitted a more advantageous offer.
The end of the Auction takes place with the moment of the best offer being confirmed.
If the highest offer is below the minimum offer, no sales agreement is concluded until the owner of the object has given permission.
If the highest offer is higher than or equal to the minimum offer, the sales agreement is concluded at the moment of the purchase.
The Organizer may demand cancellation of the concluded Agreement if the party to the Agreement, another Participant or a person acting in agreement with them influenced the result of the Auction in a manner contrary to the law or good practices.


§ 4. PAYMENT OF PRICE

The sales price of the auctioned items is a confirmed offer increased by an auction fee of 15% of the auctioned amount.
The auctioned price is subject to payment within 10 days from the end of the Auction.
Failure to pay the price on the date indicated entitles the Organizer to set an additional deadline for payment, under pain of withdrawal from the Agremeent.
In the event that the above deadline expires unsuccessfully, the Organizer will be entitled to withdraw from the Agreement and may demand compensation for any damage resulting from the delay.
Notwithstanding the above rights, the Organizer has the right to charge statutory interest for delay if he does not effectively exercise his right to withdraw from the Agreement.
The right of ownership of the object of the Auction shall pass to the winner of the Auction only when the whole price has been paid.

The price may also be paid in cash at the Organizer's office if the amount of the entire transaction, regardless of the number of payments resulting from it, does not exceed EUR 15,000, whereas transactions in foreign currencies are converted into PLN at the average foreign exchange rate announced by the National Bank of Poland on the last business day preceding the transaction date.


§ 5. ISSUE OF OBJECTS

The items being the object of the Auction shall be issued only after the Winner has paid the entire price, i.e. only after the ownership has passed.
Items can be picked up in person by the Auction Winner at the Organizer's office.
It is also possible to send the auctioned items in a form agreed individually between the Organizer and the Auction Winner.
All costs of issuance or sending the auctioned items shall be fully charged to the Auction Winner.
The items shall be sent after arranging the shipping method, paying the costs related to the Auction by the Winner and after paying the total price.
Any additional fees related to the dispatch of items of the auction shall also be charged to the Auction Winner, in particular the insurance of the shipment in question.


§ 6. CLAUSES AND ADDITIONAL RESERVATIONS

Items entered into the Register of Monuments or worth over PLN 16,000 may be exported outside of Poland only after obtaining an export license. The Organizer instructs the Participants that the free disposal of the auctioned items may be subject to restrictions resulting from the Act of 23 July 2003 on the protection of monuments and care over monuments, in particular from Article 51 of the above Act, which provides, inter alia the need to obtain permission to export certain monuments outside of Poland.
The Organizer does not take any responsibility for the above restrictions and does not declare any intermediation or assistance in the activities resulting from the above Act and aggravating the owner.
The Participant's personal data is collected only for the purpose of conducting the Auction and the conclusion and implementation of any Agreement concluded.
Access to the Participant's personal data is only provided by the Organizer and they are not made available to third parties, with the exception of the one necessary to implement the subject of the Agreement, in particular, to send the Auction items to the Auction Winner.
The Participant has the right to access their data and correct them.
Personal data, if not submitted directly by the Participant himself, come from the Onebid.pl portal.
The Organizer is not responsible for technical problems related to the functioning of the Onebid.pl portal.


§ 7. FINAL PROVISIONS

The Organizer reserves the right to change these regulations, with the reservation that changes in the regulations come into force within 7 days of their announcement on the Onebid.pl portal.
If any provisions of the regulations are invalid for any reason, the remaining provisions shall remain in force.
The applicable law for relations between Participants and the Organizer is generally applicable Polish law, in particular the provisions of the Civil Code.
The Organizer informs that in the case where the buyer is a consumer under the provisions of the Civil Code, he is entitled to the warranty for defects in the sale.
If the buyer is an entrepreneur in accordance with the provisions of the Civil Code, the Organizer excludes his liability under the warranty.
The Organizer does not provide a guarantee for auction items.
