Terms of Sale

Participation in the auction implies unconditional acceptance of these present conditions of sale:
Article 1: The sale is executed strictly for cash in Swedish Kronor (SEK). Starting prices, which are stated in Swedish kronor (SEK), are the minimum prices, below this level the item will not be sold, prices in EUR (Ð) are only for guidance puposes, it is
recommended that bidders check the exchange rate on the day at the auction. Bidders cannot bid in currencies other than Swedish kronor (SEK). Bidder must register prior to the auction and will be provided a bidding coupon. The coupon is payable at the end of
each day’s sale. The buyer of any lot shall provide bank references or pay the full purchase price, or a fractional deposit as may be determined at the discretion of the auctioneer. BIDDERS UNKNOWN TO US MUST DEPOSIT A BANK GUARANTEE AT
LEAST 48 HOURS BEFORE THE AUCTION! It is also possible for pre-registration through our website. Bidders can also bid through our website, with a credit card guarantee. Placed bids are binding. Pegasus Auctions AB are entitled to disregard bids for any
reason improper or unsafe bidders. The auctioneer has the right unilaterally in all matters relating to the auction implementation. This includes among others, a right to merge, exclude, and change the order of items from the auction catalog, and to settle disputes
that may arise during the bidding, such as who will win the item at the same bid. Telephone bidding can be arranged by appointment, Bidders who want to take part in the auction BY TELEPHONE must pay 2% surcharge fee on the won item(s)!
Article 2: Winning bid is awarded to the person who made the highest bid.
Article 3: Written bids, buyers who are unable to personally attend the auction may submit written bids by letter or fax. Pegasus Auctions AB will monitor the bids on the bidder’s behalf. Mail bids can be sent to the address below:

Received bids will be monitored and minimal incresed until the item is lost or the bidder’s maximum bid is reached. When identical bids are received, fi rst received bid will be considered. Unlimited bids will not be accepted.
Bids for Auction 1, must be received no later, than May 4th 2013 at 12.00 PM (CET)
Bids for Auction 2, must be received no later, than May 5th 2013 at 12.00 PM (CET)
NOTE! We have no ability to manage variants or to monitor maximum purchase amounts. Bids which are not adapted to the directory specifi ed bid increment, will be adjusted down to the next lower bid.
Article 4: Buyer premium (Commission) The buyer pays a commission of 18,75% (15% + VAT). Exemption from VAT is not possible for private bidders, from Sweden, the EU or outside the EU. For companies that want to be invoiced without VAT, we need in
advance documentation and registration papers of a valid VAT number, or documentation of the registration papers from companies outside the EU. For buyers who want to get an invoice without VAT, we are required to send the items to their respective address
as proof of delivery, goods purchased cannot be picked up in Sweden without VAT.
Article 5: In the event of late payment, Pegasus Auctions AB has right to either cancel the sale or to refer the matter to a collection agency. On late payments a interest rate of 5% on the prevailing current amount will be added. Payment is due within 15 days after
the auction!
Article 6: Descriptions, the items are sold as is. The buyer has duty to inspect the items prior to bidding. It is therefore responsability of the buyer to examine objects for the quality of its condition, authenticity and features. Objects may have defects which are
unnoticed. The information provided in this catalog serves only as guidance for the purchaser at his examination of the items. Pegasus Auctions AB is not responsible for inaccurate information in the catalog or on the Internet, that cannot be attributed to sevear
negligence. Any errors should be given immediately, no claims will be accepted after the sale.
Article 7: Every purchaser is responsible for the purchase is done in his name. He can not claim that he had acted for the account of a third party.
Article 8: The prices indicated in the catalog constitute the starting prices in SEK (Swedish kronor). It may happen that the prices obtained may be much higher than these prices.
Article 9: Higher bids must be spoken aloud or made by signs expressing this clearly by the bidder. Pegasus Auctions AB reserves itself the right to refuse offers coming from unknown purchasers.
Article 10: The amount of the bid increases is usually fi xed at 10%. However, Pegasus Auctions AB may modify those percentages subject to prior announcement.
Article 11: The purchase orders will be executed by Pegasus Auctions AB with care and at no additional cost. They must be confi rmed in writing.
Article 12: The profi ts and the risks pass to the purchaser immediately upon the adjudication. The transfer to the purchaser of the ownership of the goods will not take place until the purchase price has been paid in full. A 4% surcharge will be applied to credit card
payments with foreign credit cards, 0% surcharge for Swedish credit cards, cash payments, bank transfer (IBAN) or Bank Girot payments. Cash payments in other currencies are also possible, ask the Auctioneer the exchange rate prior to bidding.
Article 13: Shipping, handling and insurance are all the responsibility of the buyer, including any customs charges that may be incurred on material sent abroad. Foreign buyers are solely responsible for complying with all customs regulations. Handling costs of
100,- SEK per invoice will be on all delivered products. For shipments abroad, Pegasus Auctions AB takes no responsibility if the customer chooses not to pay insurance (2% of the total invoice amount). Customers who choose to pay by credit card will automatically
be charged the insurance fee of 2% of the total invoice amount and get their goods shipped via FedEx, this is not negotiable.
All other insurance / shipping methods must be purchased / arranged by the customer. Pegasus Auctions AB is not responsible for sold items which might not be allowed to export. Shipping Rates: For Sweden, the items will be delivered with the Swedish Post,
standard rates apply. Shipments abroad, depending on the weight, size and destination, shipment will be made thru FedEx.
Article 14: In case of contradiction between the different translations of the conditions of sale, only the Swedish text is valid.
Article 15: Disputes: Any disputes in connection with the auction shall be settled in accordance with Swedish law at the Malmö district court.
