Terms of Sale

The auction is conducted on behalf and for the account of the appropriate proprietor according to german auction regulations by cash
payment of the hammerprice in EUR. These terms and conditions of auction will be accepted by making any offer, verbal or written.
The hammerprice is exclusive of applicable German VAT (Mehrwertsteuer) according to the prevailing german VAT- legislation and
represents the basis for calculating the surcharge of 15%. The total price (hammerprice plus surcharge) is subject to the VAT as
presently applicable. Buyers from the European Union (EU) countries will be charged VAT at the rate prevailing in Germany. Buyers
from countries outside EU will be charged a surcharge of 15 % net on the hammerprice, if the auction items are exported by the
auctioneer. Delivery will be made only against payment in EUR without bankcharges to the auctioneer.
Coin dealers from EU countries other than Germany will be exempted from VAT provided that they furnish proof of their VATidentification
number (§ 27a UstG) and of further requirements pursuant to § 4 Nr.1b and § 6a, UstG.
The adjudication is made to the highest offer called three times and is a binding commitment and liability. In case of differences about
an adjudication the item concerned will be called out once again. The auctioneer is entitled to join or separate numbers. Access to the
auction is restricted to interested persons, who are in possession of a auction catalogue. The auctioneer is entitled to exclude persons
from the auction if there are particular reasons.
Minimum rates of increase for absent bidders:

After sucessful bidding, delivery of auction items will be made againt cash payment. Should payment not be made to the auctioneer
forewith or should the adjucated property be refused, the buyer loses the rights resulting from the bid and the property can be put up
for auction again. In such a case the buyer shall be liable for any shortfall while he shall have no right towards any excess proceeds.
We willl add 1% each month, if your payment doesn't arrive in time.
Orders submitted in writing will be carried out diligently and without any charge of extra commission. They have been arrived
at least 2 working-days prior to the beginning of the sale. Telephone bidding is possible on lots with a minimum estimation of EUR
500.-. An arrangemend has to be made at least 3 working-days before the sale. Orders from customers unknown to the auctioneer
can only carried out upon payment of a deposit or giving satisfactorly and verificated references. In this case the auctioneer reserves
the right to send a bill of payment prior to delivery. Shipment is at the expence of the buyer. Deliveries of consignements on
approval can not be made. Unlimited bids shall not oblige auctioneer to consider, accept or carry out such order. Maximum is 10
times the estimation.
Telephone bidding is possible on lots with a minimum estimation of EUR 500. Please make an arrangement with the auctioneers at
least 3 working-days before the sale.
Should several bids be obtained in writing bidding the same price for a given lot, the first bid received shall be given the award.
According to § 455 BGB all items of the auction are property of the consigner until complete payment.
The specifications and desriptions in the catalogue have been performed diligently and in good faith do. They do, however, not constitute
the acceptance by the auctioneer of any warranty or liability in respect of defect in material or title according to §§ 434, 459 ff.BGB.
The authenticity of all auction items is warranted up to full purchase price unless it is stated otherwise the auction catalogue.
In case of defect in material or title all claims for damage are excluded. Shipment (by mail or otherwise) of the goods shall be for the
sole cost and risk of the purchaser or recipient.
Complaints and objections, if justfied, will only be considered if made and received by the auctioneer within eight days after receipt of
the purchased items. In view of the opportunity of prior inspection to as certain the state and condition of the auction items, complaints
and objections made after the sale will only be considered, if grave mistakes in condition or description have been remained unnoticed.
Complaints can not be made by convolutes, state of condition minor than very fine (sehr schön), items with traces of trimmings etc., as
well as manipulations (damage or cleaning) the buyer made after the purchase.
Customers from abroad will have to observe all applicable laws and regulations with respect to foreign exchange, custom duties and
taxation of their countries.
Unless stipulated otherwise herein, the general rules and regulations applicable in Germany shall given any transaction in respect of
the auction. German law shall also be applicable in relation to buyers abroad. Only the german text is legal force.
The court of competency for any legal proceedings is Stuttgart.
Please notice: The prices set out in this catalogue are estimations. We will start at 90 %. Offers under this level will not be
considered.
The prices realized will be published in the form of a list immeadiately after the auction. We kindly please you to request this
list at time of your commission.
