Terms of Sale

The following conditions form the sales condition for Alfa Numismatics ApS (hereinafter AN) from 1st of August 2020. AN can at any time change these conditions. By bidding, the bidder/buyer accepts the current conditions of purchase. The conditions of purchase are applicable to both business owners and consumers.

1. Valuation of items

1.1. All items are valued by AN before they are put up for sale at auction. The description is done to the best of AN’s knowledge by thoroughly investigating the item according to the prevalent opinion of experts in the field at the time of selling.
1.2. All items are guaranteed to be genuine. If a sold item on auction is determined a forgery buy a recognized expert in the field, the coin be returned and the full amount is refunded.

2. Description of items (Including photography)

2.1. Items up for auction are presented with photographs and descriptions on www.Biddr.com. The description is described according to the best of AN’s knowledge and based on detailed research in accordance with the prevailing views among experts at the time of sale. AN reserve the right to make changes until the actual auction.
2.2. No guarantee is given that the texts and pictures portrayed on the internet are correct, complete and up-to date. Printing errors and mistakes can occur and AN reserve the right to correct them.
2.3. In some cases, AN may choose to describe an item’s provenance. Such a description is made if a former owner is publicly known and/or if the story of previous ownership sheds further light on the item and its background. In other cases, such information is left out of the description, for instance to meet the seller’s wish for privacy.
2.4. It is possible that the estimate and description are revised prior to the auction.
2.5. Items up for auction are presented only online. Potential bidders are encouraged to inspect the items closely.
2.6. AN does its best to make sure that the photos of the coins reflect the optimum depiction of the coin. Photographs are made in lighting that enables toning contrasts of the coins to be visible and most optimum. Coins can therefore look different in light when received. AN cannot be blamed for difference in lighting of the actual coin compared to the photography.
2.7. AN does not conserve, treat or repair coins after they are received from consignors. Buyers will receive the bought material as it was consigned to AN.

3. During the auction

3.1. The sale of an item is facilitated by AN on behalf of the seller. AN always sells items up for auction at the highest price offered during the bidding. If the same amount is bid by two different sides, the first bid that is received will be considered the winner.

4. Bidding

4.1. The currency used while the auctions take place is EURO. Only bids in whole numbers are possible. If amounts are displayed with decimals or other characters, an error message appears and the bid is not accepted.
4.2. Items are purchased in their present state and condition, and regardless of the type of bidding the buyer has no right to cancel his purchase, neither under the Danish Consumer Contracts Act.
4.3. Bidders are required, in accordance with AN instruction, to identify themselves and through the Biddr platform.
4.4. It is the bidder's responsibility to inform in due time of the technical requirements and requirements of the auction platform and to make any necessary installation and adjustments. Any liability of the auctioneer for damage caused by interruptions or delays due to technical defects shall be excluded.
4.5. Each submission of a bid is a binding offer, which cannot be withdrawn; the bidder remains bound by his bid until this is either outbidden or rejected by the auctioneer.
4.6. The minimum bid is the starting price. The auctioneer reserves the right to reject bids without providing reasons, to define bids and minimum bids as well as to change the time sequence of the auction. In addition, in the case of uncertainties, the auctioneer is entitled to call out lots and to withdraw lots.
4.7. Bids are only possible up to the end of the bidding. Subsequent bids cannot be considered. Time delays may occur due to electronic transmission and therefore bids must be rejected as delayed if they are issued shortly before the expiration time, but are only received thereafter by the auctioneer.
4.8. The buyer is personally liable for the provision of the hammer price and cannot claim to have bought for the account of a third party.
4.9. It is possible to bid online either by Proxy, Prebid or Live during the auction.
4.10. Pre-bids received through third party sites, by email to AN, by telephone or other means are placed when received, unless Bidders asks for proxy bid. Bidders will receive confirmation from AN upon receiving pre bids.
4.11. The bidding steps are as follows:

5. Purchase/Order

5.1. The purchasing process through the auction platform www.Biddr.com involves three to four steps in total. Every new customer has to register in order to purchase coins on www.biddr.com. In order to register one needs to make his or her customer data known, including billing address, and in case it differs from the billing address, also the shipping address. Furthermore, a password must be selected which in addition to an email address will be used as login on the portal. Next step is to login to the portal by typing in email and corresponding password. The third step is bidding on the wanted item(s). In case of being the highest bidder at the end of the auction a binding offer to conclude the contract will be issued. In the fourth step a method of payment is chosen. In the last step, there is the chance to check personal details again (e.g. Name, address, method of payment, items ordered, etc.) and correct them in the case something is incorrectly stated, before the order is shipped by AN.

6. Amounts added to the hammer price

6.1. In addition to the hammer price the buyer pays a buyer's premium for the individual items as well as other amounts (shipping, insurance) described below if the conditions for these are applicable.
6.2. The total amount that the buyer pays to AN (including shipping and insurance) is called the "purchase price".
6.3. Buyer’s Premium: In addition to the hammer price there must always be paid a Buyer’s Premium fee to AN. The fee is 15% of the hammer price + VAT (25%) of the fee, 18.75% in total. This premium is not included in the final auction bid

7. Vat exemption, payment & deposit

7.1. Some buyers can choose which type of VAT should apply to the transaction. The choice has to be communicated to AN no later than two working days after the auction ending and cannot be changed subsequently.
7.2. All cost, fees, exchange rates involving money wiring is to be paid by the buyer.

8. Payment deadline

8.1. The purchase price falls due after the hammer price has been determined, afterwards the buyer has eight days to pay AN the full purchase price.

9. Payment

9.1. The payment can be made in the following ways: With debit/credit card through the Biddr invoice, Bank Transfer or other payment accepted by AN.
9.2. All fees for bank transferring payment and other payment method are paid by the buyer. AN reserve the right to charge the debit/credit card fees imposed by the payment services companies.

10. Overdue payments

10.1. The goods remain AN property until full payment has been made.
10.2. If payment is made after a deadline, including the deadline specified interest on overdue payments will be charged and estimated in accordance with the Danish Central Bank’s official lending rate + 8% per year on the amount due.
10.3. If the purchase price, including interest, has still not been paid ten days after the demand for payment has been made, AN is entitled to cancel the purchase.
10.4. If the purchase is cancelled, AN is entitled to sell the item at a new auction and demand the costs and any difference between the new and the earlier hammer price (including the buyer’s premium) covered by the defaulting buyer.
10.5. Debit/Credit Card Fee: Amounts Added to the Hammer Price: AN reserve the right to charge the debit/credit card fees imposed by the payment services companies.

11. Conclusion of contract

11.1. The presentation of coins on biddr.ch does not constitute an offer by AN. An offer for conclusion of a contract is made through the receipt of the order of the customer by Alfa Numismatics ApS. The contract is concluded with the acceptance of the offer or order. This can happen through written acceptance or by sending the ordered product to the customer. The acceptance of the offer can be combined with the confirmation of receipt.

12. Shipment of items

12.1. The delivery is carried out as soon as the amount to be paid is finally credited to the account of AN. AN arrange the shipping at the buyer’s risk and expense. AN strives to ship won material within 3 work days after receiving payment on AN bank account.
12.2. In rare occasions item(s) won can be handed over to the buyer in person by AN. The buyers are requested to contact AN for more information.
12.3. The recipient covers the customs duties. The customer is solely responsible for customs clearance and payments. In case of dispute with Customs AN may assist in helping.
12.4. Pricing, Shipping Costs, with Insurance:

For shipment the buyer can chose to insure the purchase. If the buyer choses so the conditions are as follows:
The items are insured against loss and damage during transport. For all items that needs to be shipped an insurance of 2% of the item’s values must be added to the shipping cost. All mentioned prices are denominated in Euro.

International delivery in the European Union is carried out by DHL (or similar) and costs € 30.
International delivery in Europe is carried out by DHL(or similar) and costs € 40 (except Russian Federation).
International delivery to USA is carried out by DHL(or similar) and costs € 50.
International delivery to the rest of world is carried out by DHL (or similar) and costs € 50.

AN does not ship to the following countries: Cuba, Iran, Syria, North Korea and Crimea.

12.5. Pricing, Shipping Costs without insurance:

For shipment the buyer can chose to not insure the purchase. If the buyer choses so the conditions are as follows:
The items are not insured against loss and damage during transport. The mentioned price is denominated in Euro.

International mail not registered carried out by Postnord (or similar) and costs €5
International registered mail delivery carried out by Postnord (or similar) and costs € 17.

AN does not ship to the following countries: Cuba, Iran, Syria, North Korea and Crimea.

13. Defects in the purchased items

13.1. The lack of conformity rules of the Danish Sale of Goods Act may apply. Below is a non¬exhaustive excerpt of the buyer’s remedies in regard to lack of conformity.
13.2. The buyer is entitled to cancel a purchase if the description contained significant errors that have led to a higher hammer price than a correct description would have resulted in. In such cases, the total purchase price will be refunded. The buyer cannot demand payment of interest on the purchase price or demand payment of any other expenses or losses.
13.3. A purchase cannot be cancelled and the buyer cannot demand a refund of the purchase price or raise any other claims against AN if the description of the item is in compliance with paragraph 2.1. The same applies if evidence of forgery has required the use of scientific methods that were either not available at the time of sale, were excessively costly to use or led to the damage of the item in question.
13.4. Claims for a cancellation of a purchase must be notified to AN when the buyer has discovered the fact that entitles the buyer to cancel the purchase. This notice, however, has to be given no later than two years after the final payment date according to paragraph 8.1. The item purchased must be returned to AN in the same condition as it was on the day it was sold at auction. If these conditions are not met, the buyer loses the right to cancel the purchase and cannot claim a refund of the purchase price. The buyer is responsible for paying the costs associated with the return of the item.
13.5. Insignificant defects of items of the value of € 1000,00 or below do not constitute a right to withdraw from the contract. In case of a justified withdrawal the buyer receives back the purchase price step by step for the return of the coin in unchanged condition. All further claims of reduction of purchase price, damages or reimbursement of frustrated expenditure are excluded, except if AN concealed the defect maliciously. Otherwise all other warranty rights of the buyer are excluded.
13.6. An enterprise or tradesman is not entitled to withdrawal, if he has not complied with his or her legal obligation of inspection, notification and rejection.

14. Objections & limitations of liability

14.1. AN is aware that errors, technical difficulties and external abuse or disruptive influences may occur during the auction. Bidders cannot raise any claims against AN as a result of such events.
14.2. The buyer is always responsible for the correct payment of VAT and other costs, fees etc. in accordance with Danish and foreign regulations.
14.3. Unless otherwise stated in these conditions of purchase, AN may never be held liable for bidders’/buyers’ operating loss, loss of profits, other indirect losses or consequential loss.

15. Privacy policy

15.1. We collect, store and process data within the scope of the statutory provisions for the initiation, conclusion, processing and repackaging of a sales contract. When visiting our website, the IP address, date and time, the type of browser and the operating system of your PC, as well as the pages you are looking at, are logged. Conclusion on personal data is not possible and not intended. The personal data you provide to us e.g. via order or email (for example your name and contact details) will only be processed for correspondence with you and only for the purpose for which you provided us with the data. We only pass on your data to the shipping company commissioned with the delivery as far as this is necessary for the delivery of the goods. In order to process payments, we will pass on your payment data to the credit institution which is responsible for the payment. We assure that we do not pass on your personal data to third parties, unless we are legally obliged to do so or you have expressly given us prior consent. If we use third-party services for the execution and processing of processing processes, the provisions of the Federal Data Protection Act are complied with.

Personal data that has been communicated to us through our website will only be stored until the purpose for which they have been entrusted to us is fulfilled. Where trade and tax retention periods are to be observed, the duration of the storage of certain data may be up to ten years. If you no longer agree to the storage of your personal data, or if this has become incorrect, we will, upon appropriate instructions, make the deletion, correction or blocking of your data within the framework of the legal provisions. Upon request, you will receive free of charge information about all personal data that we have stored about you. 16. Complaints, dispute resolution and applicable law

16.1. AN can always be contacted if the bidder/buyer has a complaint.
16.2. If the bidder/buyer is a consumer and a solution cannot be found, a complaint can be submitted of the bidder/buyer to the Complaint Resolution Centre on forbrug.dk.
16.3. In Denmark, disputes must be brought before the City Court of Copenhagen.
