Terms of Sale

The auction is conducted by order and on account of the seller according to the auction rules (BGB 1/1976 1346) and in accordance with current German legal provisions for commission agents HGB (Commercial Code) and BGB (German Civil Code). The purchase price must be paid cash in EUR. Participation of the auction is limited to clients who have pre-registered with WAG-Online. Personal data is recorded for bookkeeping and invoicing purposes. Personal data will not be transferred to third parties. By placing a bid in the auction the purchaser accepts these terms and conditions.

The hammer price is the net price. It is the basis for a premium of 10 % to be paid by the auction buyer. The hammer-price and the buyer's premium add up to the total price, which is subject to the German VAT. Those gold coins that are VAT-exempt under certain legal conditions are excepted. Application of the full or reduced VAT rate is subject to the current legal provisions.

With customers from EU-countries, the effective German VAT is charged to the customers. Buyers from countries outside the EU are only charged with a premium of 10 % of the hammer price, provided that a) a VAT identification number (according to § 27 a UStG) is presented, b) other preconditions according to § 4 Nr. 1b UStG in connection to § 6 a UStG are met, and c) the coins are exported by WAG-Online. The buyer receives the lots free of bank service charges only when paying the buying price in EUR currency.

The award is knocked down after the third exclamation of the bid. The auction buyer is obliged to purchase and to make payment.

Unless agreed otherwise, buyers present at the auction have to pay auction bills immediately. Issue of invoice for non present buyers will occur within one day after award. Payment must be made within 14 days from date of invoice. In case of delayed payment, a 1.5 % interest rate is charged monthly. Items purchased can be obtained the day after the auction, at the earliest. An auction buyer present who refuses to pay the auctioneer immediately or who refuses to purchase the bought item(s) will not be delivered the item(s). The buyer loses all rights resulting from the award. The item concerned can be offered again on his account. In this case he is liable for the loss of receipts but has no right to claim additional receipts. By refusing awarded coins, the buyer forfeits his right on participating in future auctions.

Shipment is effected on expense and at risk of the auction buyer. Until payment is made in full, the seller retains title to the items.

The auction catalogue will be handed over to interested parties in .pdf format or, if requested, in print. In that case, the costs have to be borne by the buyer. Descriptions of items in the catalogue are made conscientiously. However, they do not create liability for defects of title or for material defects, according to § 434, 459ff BGB. Details on the condition of items are given according to the classifications used in the German coin commerce and are based on personal assessment. Buyers present at the auction purchase items „as seen“.

Previews of the items enables interested parties to assess the condition of auction goods. Thus, after award, complaints can be accepted only about inadvertently overlooked mount marks or repaired holes. In case of lots with multiple pieces, the number of items is only approximate; in isolated cases erroneous attributions are not impossible. No complaint can be made about these lots after award. In case of a mix-up of pictures, the text given is relevant.

No inspection of auction goods is possible at the day of the auction.

All auction participants and buyers guarantee, unless expressing otherwise, that the catalogue and the items shown therein – especially those from 1933 – 1945 – will only be used for civic education, defence against unconstitutional or anticonstitutional purposes, arts, science, research, teaching, educational advertising, or reports on the events of contemporary history, or history in general, or similar purposes (§ 86 a, Abs. 3, StGB). The auctioneer and the seller are offering these items only under the above conditions. By placing a bid, the auction bidder agrees to purchase these items, especially those displaying emblems of National Socialism, only for the above purposes and by no means to use them for propaganda, particularly in terms of § 86 a StGB.

Authenticity of items sold is guaranteed unless stated otherwise in the description. Liability for breach of warranty is limited to the hammer-price plus buyer's premium.

Auction prices are start prices. Commissions lower than the start prices won't be carried out.

The auctioneer reserves his right to to exclude persons from the auction for specific reasons.

Flat rate shipping including insurance amounts to 7 EUR for domestic, and 10 EUR for foreign customers. In case of large and/or heavy lots or books, the actual costs are charged. Should the total amount invoiced exceed 1000 EUR, shipping overseas will be done via registered and insured parcel, and a flat rate of 30 EUR per shipment will be charged. Foreign customers have to purchase according to legal provisions on foreign currency exchange, customs, and taxes of their countries. Dispatching formalities will be executed by the auctioneer who can choose any qualified forwarding agency. Costs will be imposed on the buyer.

Payment has to be made by bank transfer. If other methods of payment are chosen, the buyer must make sure that the full invoice amount is paid out. Personal cheques from foreign customers are not accepted.

The auctioneer cannot be held responsible in any way for consequences arising from tecnical difficulties, especially for such resulting from connection problems to the internet and their impact on the auction or possible disadvantages resulting from these.

All translations offered have been done to the best of our knowledge, however, only the German version is legally binding. Please send emails and letters in German or English only.

Terms of sale are also valid with foreign customers.

Should the auction buyer be a merchant, venue shall be "DE-59755 Arnsberg" as the place of auction.

After closure of the auction, prices can be viewed on the internet.
