§ 1. Introductory provisions
1. The organizer of the auction is Michał Niemczyk running a business under the name Antykwariat Numizmatyczny Michał Niemczyk, street. Żelazna 67 lok. 22, 00-871 Warsaw, NIP 113-271-52-51, telephone number (+48) 620 45 74, e-mail address: niemczyk@niemczyk.pl hereinafter referred to as the Auction House.
2. The auction will be held in Warsaw at the place and time indicated in the catalog on the website of the Auction House www.aukcjamonet.pl
3. The Auction House reserves the right to cancel or postpone the auction in the event of unforeseeable random events.

§ 2. Items of auction sale
1. The subject of the auction are movable items of a collectible nature, in particular coins, banknotes, medals, decorations or other collectibles (hereinafter: objects) put up for sale by their owners.
2. Descriptions of the facilities together with the starting price are presented in the auction catalog published on the website www.aukcjamonet.pl. Descriptions of objects included in the catalog may be supplemented or changed until the bidding begins.
3. Information about the objects presented in the auction catalog does not constitute an offer within the meaning of the Civil Code, it constitutes an invitation to conclude a sales contract within the meaning of Art. 71 of the Civil Code.
4. The Auction House guarantees the compliance of the features of the objects described in the catalog with the facts and their authenticity, unless the description of a given item states otherwise.
5. The exhibited objects are not subject to any court and tax proceedings, they are free from seizure and lien and other limited property rights, and are not subject to any claims of third parties.
6. Due to the fact that it is not possible to include all the features of a given object in the catalog, the Auction House encourages interested parties to familiarize themselves with their condition before the beginning of the auction.
7. The Auction House may withdraw the subject of the auction without giving any reason.
8. The Auction House is not liable for hidden physical defects of the offered objects, as well as for their legal defects.

§ 3. Conditions for joining the auction
1. The auction may be attended by any natural person with full legal capacity, as well as a legal person and an organizational unit without legal personality, but having legal capacity.
2. Only natural persons or legal persons or organizational units which, prior to the commencement of the procedure, will effectively subscribe to the auction (hereinafter: the Participant) will be admitted to the auction procedure.
3. A subscription may be made at the headquarters of the Auction House, as well as using the registration form available on the auction platform operating at the internet address www.aukcjamonet.pl. The interested party may also subscribe by sending an appropriate message to the e-mail address niemczyk@niemczyk.pl with the provision of their personal data, including: name, surname, telephone number, e-mail address, no later than 2 days before the planned start of the auction.
4. The auction participant receives a credit for the expenses for the auction, above which he cannot bid. The credit is for all expenses during the auction, not for individual items or auction days.
5. The Auction Participant may request an increase in the expenditure credit, however, the Auction House may make its increase conditional upon the payment of a specific deposit, which in the event of winning the auction by the Participant will be credited towards the purchase price of the object. In other cases, the bid security is returned to the Participant, subject to § 12 sec. 4 sentence 2.
6. The provisions of the Act of March 1, 2018 on counteracting money laundering and terrorist financing (i.e. Journal of Laws of 2021, item 1132) oblige the Auction House to recognize the risk and apply the financial security measures referred to in Art. . 34 sec. 1 of the same act. Performing the statutory obligation, the Auction House may require the Participant to provide additional personal data and information in addition to the data indicated when registering for the auction, before finalizing the transaction.
7. The Auction House may refuse to allow persons to participate in the auction in relation to whom there is an unexplained doubt as to their identity, the possibility of concluding a valid sales contract, suspicion of the possibility of committing a prohibited act or when a given person may interfere with the proper course of the auction by their behavior. The Auction House may also refuse to admit a person who has not previously fulfilled their obligations towards the Auction House or who have justified doubts as to their solvency.
8. The Auction House guarantees the confidentiality of submitted bids and the personal data of Auction Participants and owners of the objects sold.

§ 4. Personal participation
1. The participant admitted to the auction receives an individual number (hereinafter: identifier), which he uses during the auction to accept subsequent bid increments and is obliged to present it on each request.
2. The Auction Participant is responsible for the consequences of the use of the identifier by a third party.

§ 5. Telephone bidding
1. The participant who wishes to participate in the telephone auction is obliged to indicate the objects that he intends to bid and his telephone number which the Auction House will call during the auction. The telephone bidding may be recorded, and placing an order is tantamount to consenting to the recording of the telephone conversation. In the event of difficulties with a telephone connection, the Participant may set a limit on the order to which the Auction House will bid despite the lack of connection. If no limit is specified in the order, then the Auction House recognizes that the interested party offers at least the starting price.
2. Notification of willingness to participate in a telephone bidding shall be submitted to the Auction House no later than 24 hours before the date of the auction.
3. The Auction House is not responsible for the consequences of difficulties with access to the telephone network on the part of the Participant, if he fails to establish a telephone connection with the Participant after three attempts.

§ 6. Bidding on behalf of the Participant
1. A participant may order the Auction House to bid selected objects on its behalf up to the maximum amount specified in the order. The Auction House will bid according to the increments and up to the specified price limit.
2. The bidding order must be delivered in person to the seat of the Auction House or via e-mail to the address niemczyk@niemczyk.pl, not later than 24 hours before the auction starts.

§ 7. Online bidding (via the Internet in real time)
1. The Auction House provides interested parties with the possibility of bidding in real time via the Internet via the auction platform together with the Participants gathered in the auction room.
2. The condition of participation in the auction in the manner described in sec. 1 above, is the registration by the Participant on the auction platform via the website www.aukcjamonet.pl and his compliance with the technical requirements specified in the Regulations of the platform available at the internet address www.niemczyk.pl
3. Any actions taken by third parties who have access to the Participant's end device while actively logging into the online bidding, are recorded as the actions of that Participant. They are solely responsible for the consequences of making the terminal device available to others or leaving it unattended.
4. The Auction House is not responsible for any problems in the course of the auction caused by the Participant's lack of Internet access or other technical problems on his side.
5. When entering the auction, the Participant, by clicking the button with the amount displayed on it, submits a binding offer to purchase the object being auctioned and accepts the price in the amount shown on the button. Clicking on a button has the same importance as picking up an Bidder number in the auction room.
6. After the end of the auction, the online bidder will receive a summary of the purchases made to the e-mail address provided when registering for the auction.

§ 8. Auction process
1. The auction is conducted in Polish and in accordance with the law in force in the territory of the Republic of Poland. Auction prices are given in Polish zlotys.
2. The auction is conducted by a person appointed by the Auction House (hereinafter referred as: Auctioneer). The Auctioneer's decisions made during the auction are final.
3. The Auctioneer determines the increments (changes in the price of the object during the auction) according to the thresholds published in the catalog on the website of the given object or at his own discretion. He is entitled to settle the order of submitted bids, both from the auction room and from the Internet or telephone offer, he settles all disputes, indicates the buyer of the object.
4. The auctioneer may, depending on the interest in the object, start the bidding at the starting price lower or higher than the price of the object included in the catalog.
5. The Auction Participant's offer is binding after it has been approved by the Auctioneer.
6. The offer submitted in the course of the auction ceases to be binding if another Participant submits a higher offer and it is accepted by the Auctioneer, also implicitly.
7. The Auctioneer has the right, if he deems it necessary, to withdraw the offer, refuse to accept the offer, withdraw the object, withdraw the auction up to the indicated moment or propose the object for auction again.
8. The Auctioneer has the right not to accept the bid which, together with the previous winning bids in this auction, will exceed the amount of the expenditure loan of the given Participant.
9. The end of the auction of a given object takes place after the approval of the auctioned price (hereinafter hammered), about which the Auctioneer informs the Auction Participants.
10. The bidding made by the Auctioneer is tantamount to concluding a sale agreement between the Auction House and the winner of the auction.

§ 9. Payments
1. The auction fee and any additional fees resulting from catalog designations will be added to the auctioned amount.
2. The auction fee is 20% of the confirmation value and includes the tax on goods and services (VAT)
3. Additional charges include possible costs of transport and shipping insurance.
4. If at the time of the auction the object is located outside the EU, 8% VAT will be added to the final price, which the Auction House will inform each time in the description of the given item.
5. The bid amount, auction fee and additional fees constitute the purchase price of the subject of the auction. The purchase price is the gross price.
6. The ownership of the object is transferred to the buyer upon payment of the full purchase price.
7. Payment of the purchase price is possible immediately after the auction at the place of auction or within 7 days from the end of the auction.
8. The auctioned object will be handed over after the full purchase price is paid to the Auction House.
9. The Auction House may charge an additional storage fee for the auctioned object starting from the 8th day from the end of the auction, if it is not collected within this time or the auction winner does not pay the due shipping cost.
10. All payments are accepted in Polish zlotys.
11. The Auction House allows for the settlement of transactions in euro (EUR) or American dollars (USD) after prior arrangement of the details with the interested party. The participants taking part in the online bidding can choose the currency in which they want to bid from the currencies available on the auction platform.
12. The accepted forms of payment are: bank transfer or cash.
13. The Auction House accepts cash payments only for orders with an equivalent below EUR 10,000.
14. In the case of transfers for the day of payment, it is understood that the funds are credited to the bank account of the Auction House. Payments can be made to the following bank account:

§ 10. Collection or delivery of the subject of the auction
1. Purchase of the purchased items takes place at the place of the auction or at the seat of the Auction House, after prior agreement with the buyer on the details of the receipt.
2. At the request of the buyer, the Auction House may send the item to the address indicated by the buyer.
3. In the case of shipping the object, the buyer bears the costs of its delivery. He can choose from among the options proposed by the Auction House or he can independently choose the method of delivery.

§ 11. Complaints
1. All complaints are dealt with in accordance with the provisions of Polish law.
2. The complaint may be submitted within 14 days from the date of the sale contract.
3. The complaint should be submitted in writing and should contain the buyer's data and justification.
4. If the complaint is accepted, the buyer is obliged to return the object unchanged at his own expense. The Auction House will refund the purchase amount and the auction fee to the buyer.

§ 12. Right of withdrawal
1. The buyer of the object who is a consumer has the right to withdraw from the contract concluded remotely or outside the seat of the Auction House within 14 days of its conclusion without giving any reason, subject to paragraph 2 of this paragraph.
2. Auctions organized by the Auction House are public auctions within the meaning of Art. 2 points 6 of the Act of May 30, 2014 on consumer rights. Based on Article. 38 point 11 of this Act. Buyers who are consumers who have concluded a contract of sale through a public auction in person or using means of direct remote communication are not entitled to withdraw from the contract.
3. The Auction House is entitled to withdraw from the sales contract if it cannot apply the security measures referred to in Art. 34 sec. 1 of the Act on counteracting money laundering and terrorist financing of 1 March 2018 (Journal of Laws of 2018, item 723).
4. The Auction House may withdraw from the sales contract in the event of non-payment within the time limit specified in § 8 sec. 10 above. In this case, the bid security paid by the Participant in accordance with § 3 sec. 5 is not refundable.

§ 13. Copyright
1. The copyright for all photos, illustrations and texts related to the item produced by or for the Auction House, including the contents of the catalogs, is the property of the Auction House. They may not be used by the Buyer or other persons without the prior written consent of the Auction House.

§ 14. Legal Restrictions
1. The Auction House informs that pursuant to Art. 51 of the Act of 23 July 2003 on the protection and care of monuments, a one-time permit for the permanent export of a monument abroad is required, inter alia, collections of historical, palaeontological, ethnographic or numismatic significance, the value of which is higher than PLN 16,000.
2. It is the winner of the auction to obtain the appropriate export licenses. The Auction House does not act as an intermediary in the procedure of obtaining the permit indicated above.
3. Failure to obtain a permit to export the object abroad does not release the buyer from the obligation to pay for the purchased objects.
4. The Auction House informs that pursuant to Art. 20 paragraph 2 of the Act of November 21, 1996, the pre-emptive right to a monument sold at auction belongs to the registered museum at the auction price determined after the bid has been approved.

§ 15. Personal data
1. The Auction House, as the administrator of personal data, undertakes to take all necessary technical and organizational measures appropriate to the degree of risk, in order to ensure the security of all personal data and content provided by the Participant in connection with his participation in the auction.
2. Personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 / 46 / EC (GDPR) and the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000). "
3. Detailed rules regarding the processing of personal data are included in the GDPR Information Clause.

§ 16. Final resolutions
The Auction Regulations do not exclude or limit any rights of the Participant who is a consumer, which he is entitled to under the mandatory provisions of law. In the event of a conflict between the provisions of the Auction Regulations and the mandatory provisions of law, granting certain rights to consumers, these provisions shall prevail.
In the event of a change or annulment of any of the provisions of the Auction Regulations by a decision of the competent authority or court, the remaining provisions shall remain in force and are binding on the Auction House and the Participants.
The law applicable to the contract of sale between the Auction House and the Buyer is the law polskie.

REGULAMIN AUKCJI

§ 1. Postanowienia wstępne
1. Organizatorem aukcji jest Michał Niemczyk prowadzący działalność gospodarczą pod firmą Antykwariat Numizmatyczny Michał Niemczyk, ul. Żelazna 67 lok. 22, 00-871 Warszawa, NIP 113-271-52-51, numer telefonu (+48) 620 45 74, adres poczty elektronicznej: niemczyk@niemczyk.pl zwany dalej Domem Aukcyjnym.
2. Aukcja odbędzie się w Warszawie w miejscu i terminie wskazanym w katalogu zamieszczonym na stronie internetowej Domu Aukcyjnego www.aukcjamonet.pl
3. Dom Aukcyjny zastrzega sobie możliwość odwołania lub przesunięcia terminu aukcji w przypadku zaistnienia sytuacji losowych, których nie dało się wcześniej przewidzieć.

§ 2. Przedmioty sprzedaży aukcyjnej
1. Przedmiotem aukcji są rzeczy ruchome o charakterze kolekcjonerskim, w szczególności monety, banknoty medale, odznaczenia lub inne przedmioty kolekcjonerskie (dalej: obiekty) wystawione do sprzedaży przez ich właścicieli.
2. Opisy obiektów wraz z ceną wywoławczą są prezentowane w katalogu aukcyjnym publikowanym na stronie www.aukcjamonet.pl. Opisy obiektów zawartych w katalogu mogą być uzupełniane lub zmieniane do momentu rozpoczęcia licytacji.
3. Informacje o obiektach prezentowane w katalogu aukcyjnym nie stanowią oferty w rozumieniu przepisów Kodeksu cywilnego, stanowią one zaproszenie do zawarcia umowy sprzedaży w rozumieniu art. 71 Kodeksu cywilnego.
4. Dom Aukcyjny gwarantuje zgodność cech obiektów opisanych w katalogu ze stanem faktycznym oraz ich autentyczność, chyba że w opisie danego przedmiotu zaznaczono inaczej.
5. Wystawione obiekty nie są objęte jakimkolwiek postępowaniem sądowym i skarbowym, są wolne od zajęcia i zastawu oraz innych ograniczonych praw rzeczowych, a także nie są przedmiotem jakichkolwiek roszczeń osób trzecich.
6. Z uwagi na brak możliwości oddania wszystkich cech danego obiektu w katalogu, Dom Aukcyjny zachęca zainteresowanych do osobistego zapoznania się z ich stanem przed rozpoczęciem aukcji.
7. Dom Aukcyjny może wycofać przedmiot aukcji bez podania przyczyny.
8. Dom Aukcyjny nie podnosi odpowiedzialności za ukryte wady fizyczne oferowanych obiektów, jak również za ich wady prawne.

§ 3. Warunki przystąpienia do aukcji
1. W aukcji może wziąć udział każda osoba fizyczna, która posiada pełną zdolność do czynności prawnych, a także osoba prawna oraz jednostka organizacyjna nie posiadająca osobowości prawnej, ale posiadająca zdolność prawną.
2. Do procedury aukcyjnej dopuszczone będą jedynie osoby fizyczne lub osoby prawne bądź jednostki organizacyjne, które przed jej rozpoczęciem dokonają skutecznego zapisu na aukcję (dalej: Uczestnik).
3. Zapis może być dokonany w siedzibie Domu Aukcyjnego, a także za pomocą formularza rejestracyjnego dostępnego na platformie aukcyjnej działającej pod adresem internetowym www.aukcjamonet.pl Zainteresowany może również dokonać zapisu wysyłając na adres poczty elektronicznej niemczyk@niemczyk.pl stosowną wiadomość wraz z podaniem swoich danych osobowych obejmujących: imię, nazwisko, nr telefonu, adres poczty elektronicznej, najpóźniej na 2 dni przed planowanym rozpoczęciem aukcji
4. Uczestnik aukcji otrzymuje kredyt wydatków na aukcję, powyżej którego nie może on licytować. Kredyt dotyczy wszystkich wydatków w trakcie aukcji, a nie poszczególnych obiektów lub dni aukcji.
5. Uczestnik aukcji może wnosić o podniesienie kredytu wydatków, przy czym Dom Aukcyjny może uzależnić jego zwiększenie od wpłacenia określonego wadium, które w przypadku wygrania licytacji przez Uczestnika zostanie zaliczone na poczet ceny nabycia obiektu. W pozostałych przypadkach wadium jest zwracane Uczestnikowi z zastrzeżeniem § 12 ust. 4 zd. 2.
6. Przepisy ustawy z dnia 1 marca 2018 r. o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu (t.j. Dz.U. z 2021 r. poz. 1132) zobowiązują Dom Aukcyjny do rozpoznania ryzyka a także stosowania środków bezpieczeństwa finansowego, o których mowa w art. 34 ust. 1 tejże ustawy. Realizując obowiązek ustawowy Dom Aukcyjny przed sfinalizowaniem transakcji może wymagać od Uczestnika podania dodatkowych danych osobowych i informacji ponad dane wskazane przy zapisie na aukcję.
7. Dom Aukcyjny może odmówić dopuszczenia do udziału w aukcji osób w stosunku do których zachodzi niewyjaśniona wątpliwość co do ich tożsamości, możliwości zawarcia przez nie ważnej umowy sprzedaży, podejrzenie możliwości popełnienia czynu zabronionego lub gdy dana osoba swoim zachowaniem może zakłócać prawidłowy przebieg aukcji. Dom Aukcyjny może również odmówić dopuszczenia do udziału w aukcji osoby, która wcześniej nie wywiązała się ze swoich zobowiązań w stosunku do Domu Aukcyjnego lub istnieją uzasadnione wątpliwości co do jej wypłacalności.
8. Dom Aukcyjny gwarantuje poufność złożonych ofert oraz danych osobowych Uczestników aukcji i właścicieli sprzedawanych obiektów.

§ 4. Udział osobisty
1. Uczestnik dopuszczony do aukcji otrzymuje indywidualny numer (dalej: identyfikator), którym posługuje się w trakcie licytacji w celu akceptacji kolejnych postąpień i jest zobowiązany okazać go na każde wezwanie.
2. Uczestnik aukcji jest odpowiedzialny za skutki użycia identyfikatora przez osobę trzecią.

§ 5. Licytacja telefoniczna
1. Uczestnik, który zgłasza chęć uczestnictwa w licytacji telefonicznej jest zobowiązany do wskazania obiektów, które zamierza licytować oraz numeru swojego telefonu, pod który Dom Aukcyjny zadzwoni w czasie aukcji. Licytacja telefoniczna może być nagrywana, a złożenie zlecenia jest równoznaczne z wyrażeniem zgody na nagrywanie rozmowy telefonicznej. Na wypadek trudności z połączeniem telefonicznym Uczestnik może określić na zleceniu limit, do którego Dom Aukcyjny będzie licytować pomimo braku połączenia. Jeśli żaden limit nie jest określony na zleceniu, wówczas w takim przypadku Dom Aukcyjny uznaje, że zainteresowany oferuje przynajmniej cenę wywoławczą.
2. Zawiadomienie o chęci wzięcia udziału w licytacji telefonicznej zgłaszane jest do Domu Aukcyjnego nie później niż na 24 godziny przed terminem aukcji.
3. Dom Aukcyjny nie ponosi odpowiedzialności za skutki wynikające z trudności z dostępem do sieci telefonicznej będące po stronie Uczestnika, jeżeli nie uda mu się po trzech próbach nawiązać telefonicznego połączenia z Uczestnikiem.

§ 6. Licytacja w imieniu Uczestnika
1. Uczestnik może zlecić Domowi Aukcyjnemu licytowanie w jego imieniu wybranych obiektów do kwoty maksymalnej, oznaczonej w zleceniu. Dom Aukcyjny będzie licytował według postąpień oraz do wysokości określonego limitu ceny.
2. Zlecenie licytacji należy dostarczyć osobiście do siedziby Domu Aukcyjnego lub za pośrednictwem poczty elektronicznej na adres niemczyk@niemczyk.pl, nie później niż na 24 godziny przed rozpoczęciem aukcji.

§ 7. Licytacja online (przez Internet w czasie rzeczywistym)
1. Dom Aukcyjny udostępnia zainteresowanym możliwość licytacji w czasie rzeczywistym przez Internet za pośrednictwem platformy aukcyjnej razem z Uczestnikami zgromadzonymi na sali aukcyjnej.
2. Warunkiem uczestnictwa w aukcji w sposób opisany w ust. 1 powyżej, jest zarejestrowanie się przez Uczestnika na platformie aukcyjnej za pośrednictwem strony internetowej www.aukcjamonet.pl oraz spełnienie przez niego wymagań technicznych określonych w Regulaminie platformy znajdującego się pod adresem internetowym www.niemczyk.pl
3. Wszelkie działania podejmowane przez osoby trzecie, które mają dostęp do urządzenia końcowego Uczestnika podczas aktywnego zalogowania się do licytacji online, są odnotowywane jako działania tego Uczestnika. Ponosi on wyłączną odpowiedzialność za konsekwencje udostępnienia urządzenia końcowego innym osobom lub pozostawienia go bez nadzoru.
4. Dom Aukcyjny nie ponosi odpowiedzialności za ewentualne problemy w przebiegu aukcji spowodowane brakiem dostępu do Internetu przez Uczestnika lub inne problemy techniczne będące po jego stronie.
5. Przystępując do licytacji Uczestnik poprzez klikniecie przycisku z wyświetloną na nim kwotą składa wiążącą ofertę zakupu licytowanego obiektu i akceptuje cenę w kwocie ukazanej na przycisku. Kliknięcie na przycisk ma taką samą wagę jak podniesienie identyfikatora na sali aukcyjnej.
6. Po zakończeniu aukcji Uczestnik licytacji online otrzyma podsumowanie dokonanych zakupów na adres poczty elektronicznej podany przy zapisie na aukcję.

§ 8. Przebieg aukcji
1. Aukcja jest prowadzona w języku polskim i zgodnie z prawem obowiązującym na terenie Rzeczypospolitej Polskiej. Ceny na aukcji są podawane w polskich złotych.
2. Licytację prowadzi osoba wyznaczona przez Dom Aukcyjny (dalej Aukcjoner). Decyzje Aukcjonera podjęte w czasie aukcji są ostateczne.
3. Aukcjoner określa postąpienia (zmiany ceny obiektu podczas licytacji) według progów publikowanych w katalogu na stronie danego obiektu lub według własnego uznania. Jest on uprawniony do rozstrzygania kolejności zgłoszonych ofert, zarówno z sali aukcyjnej jak i z Internetu czy oferty telefonicznej, rozstrzyga wszelkie spory, wskazuje nabywcę obiektu.
4. Aukcjoner może, w zależności od zainteresowania obiektem, rozpocząć licytację od ceny wywoławczej niższej lub wyższej od ceny obiektu zawartej w katalogu.
5. Oferta Uczestnika aukcji jest wiążąca po zaakceptowaniu jej przez Aukcjonera.
6. Oferta złożona w toku aukcji przestaje wiązać, jeżeli inny Uczestnik złoży ofertę wyższą i zostanie ona przyjęta przez Aukcjonera, także w sposób dorozumiany.
7. Aukcjoner ma prawo, o ile uzna to za niezbędne, wycofać ofertę, odmówić przyjęcia oferty, wycofać obiekt, cofnąć licytację do wskazanego momentu lub ponownie zaproponować obiekt do licytacji.
8. Aukcjoner ma prawo nie przyjąć oferty, która łącznie z wcześniejszymi zwycięskimi ofertami na tej aukcji, przekroczy wysokość kredytu wydatków danego Uczestnika.
9. Zakończenie licytacji danego obiektu następuje po zatwierdzeniu wylicytowanej ceny (dalej przybicie) o czym Aukcjoner informuje Uczestników licytacji.
10. Przybicie dokonane przez Aukcjonera jest równoznaczne z zawarciem umowy sprzedaży pomiędzy Domem Aukcyjnym a zwycięzcą licytacji.

§ 9. Płatności
1. Do wylicytowanej kwoty doliczana jest opłata aukcyjna oraz ewentualne opłaty dodatkowe wynikające z oznaczeń katalogowych.
2. Opłata aukcyjna wynosi 20% wartości przybicia i zawiera podatek od towarów i usług (VAT)
3. Do opłat dodatkowych zalicza się ewentualne koszty transportu i ubezpieczenia przesyłki.
4. Jeśli w chwili licytacji obiekt znajduje się poza terenem UE, do ceny końcowej doliczony zostanie 8% podatek VAT o czym Dom Aukcyjny informuje każdorazowo w opisie danej pozycji.
5. Kwota wylicytowana, opłata aukcyjna oraz opłaty dodatkowe stanowią cenę nabycia przedmiotu licytacji. Cena nabycia stanowi cenę brutto.
6. Prawo własności obiektu przechodzi na nabywcę z chwilą zapłacenia pełnej ceny nabycia.
7. Zapłata ceny nabycia jest możliwa bezpośrednio po aukcji w miejscu licytacji lub w terminie 7 dni od zakończenia aukcji.
8. Wydanie wylicytowanego obiektu nastąpi po zapłacie na rzecz Domu Aukcyjnego pełnej ceny nabycia.
9. Dom Aukcyjny może naliczyć dodatkowo opłatę za przechowanie wylicytowanego obiektu począwszy od 8 dnia od zakończenia aukcji, jeżeli nie zostanie on w tym czasie odebrany lub zwycięzca aukcji nie opłaci należnego kosztu przesyłki.
10. Wszystkie płatności są przyjmowane w polskich złotych.
11. Dom Aukcyjny dopuszcza możliwość rozliczeń transakcji w euro (EUR) lub dolarach amerykańskich (USD) po wcześniejszym uzgodnieniu szczegółów z zainteresowanym. Uczestnicy biorący udział w licytacji online mają możliwość dokonania wyboru waluty w jakiej chcą licytować spośród walut dostępnych na platformie aukcyjnej.
12. Akceptowanymi formami płatności są: przelew bankowy lub gotówka.
13. Dom Aukcyjny akceptuje płatności gotówkowe jedynie dla zamówień o równowartości poniżej 10.000 EURO.
14. W przypadku przelewów za dzień zapłaty rozumie się wpływ środków na rachunek bankowy Domu Aukcyjnego. Wpłat można dokonywać na rachunek bankowy:

§ 10. Odbiór lub dostawa przedmiotu aukcji
1. Odbiór zakupionych obiektów odbywa się w miejscu przeprowadzania aukcji lub w siedzibie Domu Aukcyjnego, po wcześniejszym uzgodnieniu z nabywcą szczegółów odbioru.
2. Na życzenie nabywcy Dom Aukcyjny może wysłać obiekt pod wskazany przez niego adres.
3. W przypadku wysyłki obiektu nabywca ponosi koszty jego dostawy. Może on dokonać wyboru spośród opcji zaproponowanych przez Dom Aukcyjny bądź samodzielnie wskazać sposób dostawy.

§ 11. Reklamacje
5. Wszelkie reklamacje rozpatrywane są zgodnie z przepisami prawa polskiego.
6. Reklamacja może zostać złożona w terminie 14 dni od dnia zawarcia umowy sprzedaży.
7. Reklamacja powinna zostać złożona w formie pisemnej i powinna zawierać dane nabywcy oraz uzasadnienie.
8. W przypadku uznania reklamacji, nabywca zobowiązany jest zwrócić obiekt na swój koszt w stanie niezmienionym. Dom Aukcyjny dokona na rzecz nabywcy zwrotu kwoty zakupu i opłaty aukcyjnej.

§ 12. Prawo odstąpienia
1. Nabywca obiektu będący konsumentem ma prawo odstąpić od umowy zawartej na odległość lub poza siedzibą Domu Aukcyjnego w terminie 14 dni od jej zawarcia bez podania jakiejkolwiek przyczyny, z zastrzeżeniem ust. 2 niniejszego paragrafu.
2. Aukcje organizowane przez Dom Aukcyjny są aukcjami publicznymi w rozumieniu art. 2 pkt. 6 ustawy z dnia 30 maja 2014 r. o prawach konsumenta. Na podstawie art. 38 pkt 11 tejże ustawy Nabywcom będącym konsumentami, którzy zawarli umowę sprzedaży w drodze aukcji publicznej osobiście lub przy użyciu środków bezpośredniego porozumiewania się na odległość nie przysługuje prawo do odstąpienia od umowy.
3. Dom Aukcyjny jest uprawniony do odstąpienia od umowy sprzedaży, jeżeli nie może zastosować środków bezpieczeństwa, o których mowa w art. 34 ust. 1 Ustawy o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu z dnia 1 marca 2018 r. (Dz. U. z 2018 r. poz. 723).
4. Dom Aukcyjny może odstąpić od umowy sprzedaży w przypadku braku zapłaty w terminie określonym w § 8 ust. 10 powyżej. W takim przypadku wadium wniesione przez Uczestnika zgodnie z § 3 ust. 5 nie podlega zwrotowi.

§ 13. Prawa autorskie
Prawa autorskie do wszystkich zdjęć, ilustracji i tekstów związanych z obiektem, sporządzonych przez lub dla Domu Aukcyjnego, włączając zawartość katalogów, stanowią własność Domu Aukcyjnego. Nie mogą być one wykorzystane przez Nabywcę ani inne osoby bez uprzedniej pisemnej zgody Domu Aukcyjnego.

§ 14. Ograniczenia prawne
1. Dom Aukcyjny informuje, że zgodnie z art. 51 ustawy z dnia 23 lipca 2003 r. o ochronie zabytków i opiece nad zabytkami jednorazowego pozwolenia na stały wywóz zabytku za granicę wymagają m.in. kolekcje o znaczeniu historycznym, paleontologicznym, etnograficznym lub numizmatycznym, których wartość jest wyższa niż 16 000 zł.
2. Obowiązek uzyskania stosownych pozwoleń wywozowych spoczywa na zwycięzcy licytacji. Dom Aukcyjny nie pośredniczy w procedurze uzyskania pozwolenia wskazanego powyżej.
3. Brak uzyskania zezwolenia na wywóz obiektu za granicę nie zwalnia nabywcy z obowiązku zapłaty za zakupione obiekty.
4. Dom Aukcyjny informuje, że na podstawie art. 20 ust. 2 ustawy z dnia 21 listopada 1996 r. prawo pierwokupu zabytku sprzedawanego na aukcji przysługuje muzeum rejestrowanemu po cenie wylicytowanej ustalonej po przybiciu oferty.

§ 15. Dane osobowe
1. Dom Aukcyjny jako administrator danych osobowych zobowiązuje się podjąć wszelkie konieczne środki techniczne i organizacyjne odpowiednie do stopnia zagrożenia, w celu zapewnienia bezpieczeństwa wszystkich danych osobowych i treści przekazywanych przez Uczestnika w związku z jego udziałem w aukcji.
2. Dane Osobowe przetwarzane są zgodnie z postanowieniami Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r., w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (RODO) oraz Ustawy z dnia 10 maja 2018 r. o ochronie danych osobowych (Dz.U. z 2018 r. poz. 1000)”.
3. Szczegółowe zasady dotyczące przetwarzania danych osobowych zawarto w Klauzuli informacyjnej RODO.

§ 16. Postanowienia końcowe
4. Regulamin aukcji nie wyłącza oraz nie ogranicza żadnych uprawnień Uczestnika będącego konsumentem, które przysługują mu na mocy bezwzględnie obowiązujących przepisów prawa. W przypadku sprzeczności pomiędzy postanowieniami Regulaminu aukcji a bezwzględnie obowiązującymi przepisami prawa, przyznającym konsumentom określone uprawnienia, pierwszeństwo mają te przepisy.
5. W razie zmiany lub unieważnienia któregokolwiek z postanowień Regulaminu aukcji decyzją kompetentnego organu lub sądu, pozostałe jego postanowienia pozostają w mocy i są wiążące dla Domu Aukcyjnego i Uczestników.
6. Prawem właściwym dla umowy sprzedaży pomiędzy Domem Aukcyjnym a Nabywcą jest prawo polskie.
