Participants in the auction are obliged to comply with the following regulations, which are taken to be accepted

1. Foreword
The items for sale are owned by a third party, who guarantees the lawful provenance. Varesi s.r.l. acts exclusively as an agent in the interest of each seller, whose data is recorded in Public Security registers. The result of the sale affects the seller directly: Varesi s.r.l. procures no rights nor assumes
obligations towards the successful bidder or third party in general, other than those arising from its function as agent.
It should be noted in particular that it is specified that this sale constitutes an aleatory contract and therefore a guarantee of infringement is excluded, for the scope and effects of art. 1488 paragraph 2 of the Civil Code.

2. Authenticity and quality
The goods offered have been carefully examined and deemed authentic (see also #10.1). The qualitative assessments are made in a fair and professional manner, taking into account the age of the goods and production techniques. However, this is a personal judgement and, as such, questionable. (see also #10.3 and 10.4).

3. Auction starting price
The figure indicated in the catalogue does not constitute an estimate but an auction starting price, below which no bids will be accepted.

4. Participation in the auction
1. You may participate in the auction in person or by submitting bids by 5 p.m. on the day before the first day of the auction by internet, letter, fax, e-mail or telephone (in the latter case, written confirmation is required). Varesi s.r.l. will not apply any additional expenses for the execution of commissions. By signing the appropriate offer form unconditional acceptance of these regulations is submitted.
2. In the case of bids that do not comply with the minimum bids indicated on the site aste.varesi.it, these will be rounded up or down (e.g. € 182 will be recorded as € 180 and € 178 as € 180)
3. Commissions bearing offers that are not clearly defined (e.g. ‘at best’, ‘take’, or ‘total%’ more than the maximum bid) will not be taken into consideration.

5. Cut Bid
The English term "cut bid" indicates a bid of an amount lower than the increment imposed by the auctioneer.
It is only accepted for amounts over € 2000. A bidder wishing to make use of the "cut bid" will no longer be able to bid if the cut bid is exceeded.
Important: Italian law requires us to identify buyers at auction, bidders are required to provide a copy of ID document

6. Participation in the auction by telephone
1. The participation by telephone must be agreed with Varesi s.r.l. within and not later than 24 hours before the day of the auction, communicating the number of lots, the telephone number and the personal data.
2. Varesi s.r.l. reserves the right not to accept requests for participation by telephone for lots with an auction base lower than € 500.-
3. In the event that Varesi s.r.l. is unable to reach the client by telephone, for any reason whatsoever (busy or malfunctioning lines, incorrect transcription of telephone numbers or lot numbers), nothing can be debited to Varesi s.r.l.

7. Adjudications and withdrawal of the material
1. In the case of two bids of equal amount, the lot shall be adjudicated to the first bid registered. Where there is an equal number of bids, the hall takes precedence over all other bids (including live).
2. Multiple written bids: one at € 700 and one at € 500. The lot will be awarded to the highest bid at € 550 (500+one step). If the gap between the two bids is less than the minimum bid, the lot shall be given to the highest bid received, for the full amount.
3. Auction fees of 18% VAT included, shall be added to the adjudication price.
4. Buyers present at the sale must collect the items awarded them by the end of the auction, paying by cash (up to € 2,000.00) or bank draft. Distant buyers must make payment within 7 days of receiving the invoice.
5. Shipment shall be by insured or registered postal package. The cost of shipping is 1% of the adjudicated amount (min. € 15) which includes insurance against theft. Courier Service is also available, with cost on request.
6. Adjudication results can be supplied to Postal Bidders by calling +39.0382.570685 after the second day of the sale.

8. Exports
The shipments abroad (even to EEC countries) of coins or medals over 70 years old are subject to the following conditions, the submission of specific paperwork to the Ministry of Cultural Heritage through the SUE internet
service:
a) For lots with a value of less than € 13,500: Self-certification with a 30/40 day waiting period from date of delivery of the file to the Export Office (upon receipt of payment)
b) For lots with a value equal to or greater than € 13,500: Certificate of Free Movement with waiting period (indicative) of 10/12 weeks from delivery of the file to the Export Office.
The cost of processing the paperwork is 2%
Lots marked with the symbol § are not shipped outside Italy

10. Dispute or Claim
Complaints are admissible:
1. Within 10 years from the day of the auction for disputes on authenticity, by presenting a reasoned report, signed by an officially recognised expert.
2. For postal services that cause damage or loss, even partial, of the contents of the package. (Complaints must be made immediately to the postman upon receipt of the parcel) See also #10.8
No complaint is admissible:
3. Regarding the state of preservation, as the assessment of the state of preservation is strictly personal, the purchase is bound by the clause on preservation (“as seen, liked").
4. For defects mentioned in the catalogue or easily noticeable in photographs.
5. For everything concerning multiple lots (conservation, composition etc.)
6. In case the purchaser has behaved in a manner contrary to the present regulation.
7. For incorrect bibliographic reference numbers in the description sheets.
Complaint procedure
8. The dispatch of the disputed material must be made by insured, unmarked mail (under penalty of refusal) and in suitable packaging. The sender is directly responsible for the care of the material until it is delivered to Varesi s.r.l.
The object of dispute must be returned in the same conditions of origin and free from any bond and/or dispute with third parties.
9. In the event of postal theft, the customer must forward all documentation in his possession (statement to the postman and report to the Postal Authorities).

12. Miscellaneous
1. The auctioneer shall have the right, during the Sale, to group, divide or withdraw the lots and, if necessary, to change the order of the lots and, in the event of a dispute over an adjudication to reopen the auction.
2. Each buyer is directly responsible for the purchases made and cannot claim to have acted on behalf of other persons or entities.
3. The auctioneer, at his sole discretion, may order the removal of anyone who disturbs or obstructs the bidding. To this end, he may request the intervention of the police in order to expel those who do not comply with his request to leave the sales room.
For any controversy the competent court is exclusively that of Pavia, Italy

CONDIZIONI DI VENDITA
I partecipanti all’asta sono tenuti all’osservanza del presente regolamento, che dichiarano di accettare

1. Premessa
Quanto forma oggetto della vendita è di proprietà di terzi, che ne garantiscono la lecita provenienza.
La Varesi s.r.l. agisce esclusivamente quale mandataria nell’interesse di ciascun venditore, i cui dati sono riportati sui registri di P.S. Gli effetti della vendita influiscono direttamente sul venditore: nei confronti dell’aggiudicatario o di terzi in genere la Varesi s.r.l. non acquista diritti né assume obblighi in proprio oltre a quelli derivanti dalla propria qualità di mandataria. In particolare si precisa che la present vendita costituisce contratto aleatorio ed é quindi esclusa la garanzia per l'evizione, ai fini e per gli effetti dell'art. 1488 comma 2 del Codice Civile

2. Autenticità e qualità
Quanto proposto è stato attentamente esaminato e ritenuto autentico (vedi anche punto 10.1). Le valutazioni qualitative sono formulate in maniera equa e professionale, tenendo conto dell'età del bene e delle tecniche di produzione. Si tratta comunque di un giudizio personale e, come tale, opinabile. (vedi anche punto 10.3 e 10.4)

3. Basi d’asta
La cifra indicata in catalogo non costituisce stima bensì base d’asta, al di sotto della quale non si accettano offerte

4. Partecipazione all’asta
1. Si può partecipare all’asta di persona oppure tramite offerte da far pervenire entro le ore 17.00 del giorno precedente il primo giorno d’asta, mediante internet, lettera, fax, e-mail o telefono (in quest’ultimo caso è necessaria la conferma scritta). La Varesi s.r.l. non applicherà nessuna spesa
aggiuntiva per la cura delle commissioni. Con la firma dell’apposito modulo di offerta si sottoscrive in maniera esplicita l’accettazione incondizionata del presente regolamento.
2. Nel caso di offerte che non rispettano gli scatti minimi riportati sul sito aste.varesi.it, queste verranno arrotondate per difetto o per eccesso (es. offerta Euro 182 verrà registrata come Euro 180 ed Euro 178 come Euro 180)
3. Commissioni recanti offerte non ben definite (es. "al meglio", "prendere", "tot% in più della massima offerta") o vincolate all'acquisto o meno di altri lotti non verranno prese in consideration

5. Cut Bid
Con il termine anglosassone "cut bid" si indica una offerta inferiore allo scatto imposto dal battitore ed é accettata esclusivamente per importi superiori ai 2000 Euro. L'offerente che intendesse avvalersi dell'offerta "cut bid"
non potrà più rilanciare nel caso tale offerta venisse superata
Importante: la legge italiana ci impone l'obbligo di identificazione degli acquirenti all'asta, pertanto gli offerenti sono tenuti a fornire Codice Fiscale e copia di un documento in corso di validità

6. Partecipazione all’asta tramite telefono
1. La partecipazione telefonica deve essere concordata con Varesi srl entro e non oltre le 48 ore precedenti il giorno dell'asta, comunicando il numero dei lotti, il recapito telefonico ed i dati anagrafici completi
2. La Varesi s.r.l. si riserva il diritto di non accettare richieste di partecipazioni telefoniche per lotti con base d'asta inferiore ad Euro 500,00
3. Nel caso di impossibilità da parte della Varesi s.r.l. a raggiungere telefonicamente il cliente, per qualsiasi motivo (linee occupate o malfunzionanti, erronea trascrizione dei recapiti telefonici o dei numeri dei lotti), nulla potrà essere addebitato alla Varesi s.r.l.

7. Aggiudicazione e ritiro del materiale
1. Nel caso di due offerte di pari entità il lotto verrà aggiudicato a quella registrata per prima. A parità di offerta la sala ha la precedenza su tutte le altre offerte (live incluso)
2. Offerte scritte plurime: una ad Euro 700 ed una ad Euro 500. Il lotto verrà aggiudicato all'offerta Maggiore ad Euro 550 (500+uno scatto). Nel caso il divario tra le due offerte fosse inferiore allo scatto minimo, il lotto verrà assegnato alla massima offerta ricevuta, alla cifra piena.
3. Al prezzo di aggiudicazione vanno aggiunti i diritti d’asta in misura del 18% I.V.A.inclusa
4. Gli acquirenti presenti alla vendita devono ritirare quanto a loro aggiudicato entro il termine dell’asta, provvedendo al pagamento tramite contanti (fino ad € 4.999,00) o assegno circolare. Gli aggiudicatari a
distanza devono eseguire il pagamento entro 7 giorni dalla ricezione della fattura
5. La spedizione sarà effettuata a mezzo plico postale assicurato. Il costo della spedizione è pari all'1% dell'importo aggiudicato (min. Euro 10 per ogni assicurata convenzionale ed Euro 15 per ogni plico contro-assegno) e include l'assicurazione contro il furto. In alternativa è possibile richiedere l’invio tramite corriere privato, i cui costi verranno quantificati al momento della spedizione.
6. I concorrenti all’asta tramite ordine postale sono tenuti ad informarsi delle eventuali aggiudicazioni, chiamando lo 0382.570685 dal secondo giorno successivo alla vendita.

8. Esportazioni
La spedizione all'estero (anche verso Paesi della CEE) di monete o medaglie aventi più di 70 anni è soggetta all'inoltro al Ministero dei Beni Culturali di specifiche pratiche tramite il servizio internet SUE.
Per lotti di valore inferiore ai 13.500 Euro: Autocertificazione (DVAL) con tempi di attesa di circa 30/40 gg dall'inoltro della pratica al competente Ufficio Esportazione (ovvero dalla ricezione del pagamento)
Per lotti di valore pari o superiore ai 13.500 Euro: Attestato di Libera Circolazione (ALC) con tempi di attesa (indicative) di 10/12 settimane dalla consegna della pratica al competente Ufficio Esportazione.
Per l'evasione delle pratiche di esportazione verrà esposto un costo pari al 2%
Varesi srl non assume nessun obbligo o responsabilità in merito all'esito e/o alle tempistiche di tali pratiche I lotti contrassegnati in catalogo con il simbolo § non vengono spediti all'estero

9. Metodi di pagamento (per coloro che non sono presenti all'asta)

10. Contestazioni
Viene ammesso reclamo:
1. Entro 10 anni dal giorno dell'asta per contestazioni sull’autenticità, esibendo perizia motivata a firma di perito ufficialmente riconosciuto
2. Per disservizi postali che cagionino un danno o una perdita, anche parziale, del contenuto del plico (il reclamo deve essere fatto immediatamente al postino, all’atto della ricezione del plico) Vedi # 10.8
Non viene ammesso reclamo:
3. In merito allo stato di conservazione, essendo la valutazione dello stesso strettamente personale e l'acquisto vincolato dalla clausola “come visto, piaciuto”
4. Per difetti citati in catalogo o facilmente riscontrabili in fotografia
5. Per tutto quello che riguarda i lotti multipli (conservazione, composizione ecc.)
6. In caso l’acquirente abbia tenuto un comportamento in contrasto con il presente regolamento
7. Per erronei numeri di riferimento bibliografico nelle schede descrittive
Modalità per il reclamo
8. L’invio del materiale contestato deve essere effettuato mediante assicurata, non contrassegno (pena il rifiuto della stessa) e utilizzando imballaggio idoneo. Il mittente è direttamente responsabile della cura del materiale fino alla consegna dello stesso alla Varesi s.r.l. Quanto oggetto di contestazione deve essere reso nelle medesime condizioni d'origine e libero da qualsiasi vincolo e/o controversia con terzi
9. Nel caso di furto postale il cliente dovrà trasmettere tutta la documentazione in suo possesso (dichiarazio- ne al postino e denuncia effettuata ai Carabinieri o alla Polizia Postale)

12. Varie
1. Il direttore della vendita ha il diritto, durante la vacazione, di raggruppare, dividere o ritirare i lotti ed eventualmente variarne l’ordine e, in caso di contestazione su una aggiudicazione, di riaprirne la gara.
2. Per gli oggetti sottoposti a notifica dello Stato, ai sensi della Legge 18/02/2009 n. 9 gli acquirenti sono tenuti all’osservanza delle relative disposizioni vigenti.
3. Ogni acquirente è direttamente responsabile degli acquisti effettuati e non può pretendere di aver agito per conto di altre persone o Enti.
4. Il direttore della vendita, a suo insindacabile giudizio, può fare allontanare chiunque disturbi od ostacoli lo svolgimento delle gare. A tal scopo può chiedere l’intervento della forza pubblica per fare espellere coloro che non ottemperino al suo invito ad allontanarsi dalla sala delle vendite.
Per ogni controversia il Foro competente è esclusivamente quello di Pavia
